哈尔滨市道外区集体土地征收对策研究

【摘要】：文章基于农村集体土地制度和集体土地征收相关理论阐述为基础,以农村集体土地征收问题为研究对象,通过对哈尔滨市道外区团结镇农村集体土地征收研究为案例载体,首先科学阐述农村集体土地制度的相关理论,梳理我国的土地制度和征收现状,其次结合实际案例,研究了哈尔滨市农村集体土地征收中存在的一些问题。在介绍哈尔滨市道外区团结镇基本情况的背景下,对哈尔滨市农村集体土地征收中存在的问题进行论述,如区级政府土地发展观念缺失,哈尔滨市集体土地征收的程序不完善,土地征收过程群众冲突较多,集体土地征收的补偿机制不合理,失地农民的社会保障缺失等问题。文章对问题产生的原因进行了分析,主要分析了区级政府土地征收的动因分析、利益关联、角色困境、农村传统土地思想的负面影响、集体土地的征收法理依据缺失、土地征收过程中存在非法行为、集体土地产权制度存在缺失、集体土地征收补偿力度不强和失地农民的的社会保障机制不完善等方面的原因。文章最后提出了哈尔滨市农村集体土地征收的合理对策,重点研究了转变政府土地利用和发展观念,整顿集体土地征收的利益链条,完善集体土地征收的法律要素,坚决打击非法占地、暴力拆迁和非法套取补偿款等行为,规范土地征收的程序机制,完善集体土地征收补偿机制,加大失地农民的社会保障力度等方面的措施和方式,为哈尔滨市农村集体土地征收的现实问题提供一定的理论支持和现实帮助。
[Abstract]:Based on the system of rural collective land and the theory of collective land expropriation, this paper takes the issue of rural collective land expropriation as the research object, and studies the rural collective land expropriation in Tuanjie Town, Daowai District, Harbin as a case carrier. Firstly, this paper scientifically expounds the relevant theories of rural collective land system, combs the present situation of land system and expropriation in our country, and then studies some problems existing in the rural collective land expropriation in Harbin with practical cases. Under the background of introducing the basic situation of Tuanjie Town in Daowai District, Harbin City, this paper discusses the problems existing in the rural collective land expropriation in Harbin, such as the lack of the concept of land development of district government and the imperfect procedure of collective land expropriation in Harbin. There are many conflicts in the process of land expropriation, unreasonable compensation mechanism of collective land expropriation and lack of social security for landless farmers. This paper analyzes the causes of the problems, mainly analyzes the causes of land expropriation at district level, interest association, role dilemma, the negative impact of traditional rural land ideas, and the lack of legal basis for collective land expropriation. There are some reasons in the process of land expropriation, such as illegal behavior, lack of collective land property right system, weak compensation for collective land expropriation and imperfect social security mechanism of landless farmers. Finally, the paper puts forward the reasonable countermeasures of rural collective land expropriation in Harbin, focuses on changing the concept of government land use and development, rectifying the interest chain of collective land expropriation, and perfecting the legal elements of collective land expropriation. Resolutely crack down on illegal land occupation, violent demolition and illegal expropriation of compensation, standardize the procedural mechanism for land expropriation, improve the compensation mechanism for collective land expropriation, and increase the social security efforts of land-losing farmers. To provide some theoretical support and practical help for the practical problems of rural collective land expropriation in Harbin.
