失地农民社会保障问题及改革路径研究

【摘要】：自改革开放以来,随着工业化、城市化的推进,农村土地被大量征用,使得一部分农民失去了土地这个赖以生存的生产资料。在我国现行的征地制度下,农民土地被征用也就意味着土地所有权性质由原来的集体所有转变为永久的国家所有,农民永久地失去土地,而失地农民所得到的补偿标准过低,有时很难维持原有生活,同时农民也永久地失去由土地提供的各种保障功能。因此如果不能恰当解决好失地农民的基本生活、养老、医疗和就业等保障问题,随时都有可能引发社会矛盾和冲突。这一问题和现实也已经受到了政府和相关学者的关注广泛重视。在当前形势下,解决失地农民生活、维护失地农民合法权益等问题的有效措施主要是改革土地利用与管理制度,为失地农民参加社会保障提供资金,完善社会保障制度。在此背景下,本文首先对国内外现行的土地制度和社会保障制度进行分析研究,努力尝试找出可以学习的经验以及存在的缺陷。其次,重点以张家港市为例,通过对张家港市失地农民的实证调查研究,分析得出当地失地农民征地情况、生活现状以及对于现行政策的满意状况,同时也总结出了他们对保障体系中不同内容的需求程度、接受程度以及他们对社会保障内容的个人期望。最后通过对社会保障建设的必要性的阐述,指出为失地农民建立完整的社会保障体系是是现实的最佳选择,也是有基础和条件实现的。本文还通过借鉴其他地区好经验的做法,提出建立健全失地农民社会保障的有效路径,以期切实保护到失地农民的自身利益。我们希望能够在理论上、政策上进行探索与创新,进而为推进城市化进程的具体活动提供有价值的参考。
[Abstract]:Since the reform and opening up, with the promotion of industrialization and urbanization, a large number of rural land has been expropriated, making a part of the farmers lose the production data on which the land is living. Under the current system of land expropriation, the expropriation of farmers' land means that the land ownership quality is changed from the original collective ownership to the permanent state. Yes, farmers permanently lose their land, and the compensation standards for land lost farmers are too low, and sometimes it is difficult to maintain their original life. At the same time, farmers also permanently lose all kinds of security functions provided by the land. Therefore, if we can not properly solve the basic life of the landless farmers, pension, medical care and employment, it is likely to be triggered at any time. Social contradictions and conflicts. This problem and reality have also been paid attention to by the government and relevant scholars. Under the current situation, the effective measures to solve the problems of land lost farmers' life and the protection of the legitimate rights and interests of the landless farmers are mainly to reform the land use and management system, provide funds for the landless peasants to participate in social security and improve their participation in social security. Social security system.
Under this background, this paper first analyzes the current land system and social security system at home and abroad, and tries to try to find out the experiences and shortcomings that can be learned. Secondly, taking Zhangjiagang as an example, through the empirical investigation of the landless peasants in Zhangjiagang, the situation of land expropriation of land lost farmers is analyzed. The status quo and the status of the current policy, as well as the degree of their demand for the different content of the security system, the degree of acceptance and their personal expectations for the content of social security.
Finally, through the exposition of the necessity of social security construction, it is pointed out that the establishment of a complete social security system for the landless peasants is the best choice of reality, and also the basis and conditions. This paper also proposes to establish and improve the effective path of establishing and improving the social security of the landless farmers by using the good experience of other regions for the purpose of protecting the land. To the own interests of the landless peasants, we hope to explore and innovate in theory and policy, and thus provide valuable reference for the concrete activities of the process of urbanization.
