山西省土地流转中农民权益保障机制研究

【摘要】：土地对人类的生存发展具有重要意义,土地问题是三农的重要问题,土地流转对农民权益也有着很大的影响。本文基于理论的指导及实地分析,研究山西省土地流转中农民权益保障机制。本文研究是依据现有的理论基础,借鉴国内外相关的农村土地流转与农民保障工作的经验,在明确研究对象、研究方法以及界定清楚相关概念后,以山西省土地流转及失地农民为调查对象,进行土地资源评价与经营趋势判断,并通过调查法、访谈法等方式了解山西省土地流转现状及模式,找出省内土地流转存在的流转不规范、信息不畅通、农民主体无保障等问题,并分析山西省农民保障水平对土地流转的支撑及农民保障工作的主要经验。在此基础上,指出土地流转中农民权益保障存在的问题,主要有：流转流程不完善、社保体系不健全、收入结构变化对农民收入的影响以及农民身份的转变问题,并从制度、政府、农民等方面分析导致问题出现的原因。最后,完成土地流转中农民保障的机制的构建,提出建立推进农村土地流转的市场管理机制,即健全基本流转程序、完善制度建设、加快土地确权登记及完善补偿救济体制；建立土地流转对农民身份转变机制,即转变农民观念、健全技能培训、完善社会认同等;建立土地流转中农民的经营性、工资性、财产性、转移性收入等多重收入体制：建立与土地流转农民相匹配的最低生活保障、农民养老保障、医疗保障及教育就业保障等社会保障制度。
[Abstract]:Land is of great significance for the survival and development of human beings. Land problem is an important problem of agriculture and farmers. Land circulation has a great influence on the rights and interests of farmers. Based on the theoretical guidance and field analysis, this paper studies the protection mechanism of farmers' rights and interests in the land circulation of Shanxi province. This paper is based on the existing theoretical basis and draws on the domestic and foreign phase. After the experience of rural land circulation and farmers' guarantee work, the land circulation and the management trend of land lost in Shanxi province are judged by the land circulation and land lost farmers as the investigation object, and the status of the land circulation in Shanxi province is understood through the investigation and interview methods. Mode, find out the circulation of land circulation in the province, the circulation is not standard, information is not smooth, the peasants' main body is not guaranteed, and the main experience of supporting the land circulation and the work of farmers' guarantee in Shanxi province is analyzed. On this basis, the problems in the protection of farmers' rights and interests in the land circulation are pointed out mainly: the flow process is not the same. Perfect, the social security system is not sound, the change of income structure on Farmers' income and the change of farmers' identity, and from the system, the government, the farmers and other aspects to analyze the causes of the problems. Finally, the construction of the mechanism of farmers' guarantee in the land circulation is completed, and the market management mechanism to promote the circulation of rural land is put forward, that is health. All the basic circulation procedures, perfect the system construction, speed up the registration of land confirmation and improve the compensation relief system, and establish the transformation mechanism of land transfer to farmers, that is to change the concept of farmers, improve the training of skills, improve the social identity and so on, and establish the management, wage, property, and transferable income of the farmers in the land circulation. System: establishing a social security system, such as minimum living security, farmers' old-age security, medical insurance and education and employment protection, which are compatible with peasants in land transfer.
