风险社会视角下立法决策观念的变革

【摘要】：伴随着工业文明的进步,风险问题日益凸显,已经成为了人们关注的焦点,现代社会的表征。因此,社会迫切需要人们从风险的视角出发,反省社会发展的模式。法律亟需变革以应对因“风险社会”降临所产生的新的社会秩序,作为推动法律变革的动力源泉,立法决策观念的变革更是迫在眉睫。从风险社会的视角下研究立法决策观念的变革,有助于丰富立法决策理论的观点和内容,有助于推动我国立法决策活动的发展与创新。从现实意义上来看,立法决策观念的变革关系到法治建设,关系到我国未来发展的走向。本文剖析了风险社会对立法决策观念的挑战,并对中国立法决策观念的变革提出了意见。本文主要分为四个部分:第一部分阐述了问题提出的背景、研究现状、研究意义以及研究思路。第二部分对风险社会的概念、理论进行了阐述,并揭示了风险社会形成的原因以及风险社会的特征,为后文的立法决策观念的变革提供了理论基础。第三部分是对国内外有关风险的立法以及立法决策现状的描述,并从立法决策中的原则、立法决策中的权力、立法决策中的权利以及立法决策中的责任等角度阐述风险社会对现阶段的立法决策观念提出的挑战。第四部分是本论文的重点部分。该部分结合国外的先进的立法经验,从民主协商原则、科学理性原则以及风险预先防范原则角度论述了风险社会下立法决策原则观念的变革;从重视权力与权力合作,权力与权利合作的角度论述了风险社会下立法决策中权力观念的变革;从重视安全的权利观、重视社会保障的权利观等角度论述了风险社会下立法决策中权利观念的变革;从明确个人责任以及强化政府的责任角度论述了风险社会下立法决策中责任观念的变革。
[Abstract]:With the progress of industrial civilization, the problem of risk has become the focus of attention and the representation of modern society. Therefore, society urgently needs people to reflect on the mode of social development from the perspective of risk. It is urgent for the law to change in order to deal with the new social order arising from the coming of "risk society". As the motive source of promoting the legal reform, the change of the idea of legislative decision is urgent. It is helpful to enrich the viewpoints and contents of the legislative decision theory and to promote the development and innovation of the legislative decision-making activities in our country by studying the change of the idea of legislative decision from the angle of view of the risk society. From a realistic point of view, the reform of the concept of legislative decision is related to the construction of the rule of law and the future development of our country. This paper analyzes the challenge of the risk society to the idea of legislative decision, and puts forward some suggestions on the change of the concept of legislative decision in China. This paper is divided into four parts: the first part describes the background, research status, research significance and research ideas. The second part expounds the concept and theory of risk society, and reveals the reasons for the formation of risk society and the characteristics of risk society, which provides a theoretical basis for the later reform of the concept of legislative decision-making. The third part is to describe the domestic and foreign legislation on risk and the current situation of legislative decision-making, and from the principles of legislative decision-making, the power in legislative decision-making. From the angle of right in legislative decision and responsibility in legislative decision, this paper expounds the challenge of risk society to the concept of legislative decision at present stage. The fourth part is the key part of this paper. This part combines the advanced legislative experience of foreign countries, from the democratic consultation principle, the scientific rational principle and the risk precaution principle angle elaborated under the risk society legislative decision-making principle idea transformation; From the angle of attaching importance to power and power cooperation and power and right cooperation, this paper discusses the change of power concept in the legislative decision-making under the risk society. This paper discusses the change of the concept of right in the legislative decision-making in the risk society from the view of attaching importance to the view of the right of security and the view of the right of the social security. This paper discusses the change of the concept of responsibility in the legislative decision in the risk society from the angle of clarifying individual responsibility and strengthening the responsibility of the government.
