美国应对校园网络欺凌的策略及其启示

【摘要】:在美国,媒体报道因网络欺凌而导致的青少年自杀或受到生理、心理伤害的事件屡见不鲜,美国各州也已经陆续立法管制校园网络欺凌。网络欺凌是传统校园欺凌在网络上的延伸,又不乏新的特点。网络欺凌的空间辐射范围更广,欺凌手段更具有隐蔽性,虚拟距离使得欺凌者难以预知欺凌行为造成的伤害,加之网络欺凌的开放性与持续性特征,给应对校园网络欺凌带来不小的挑战。面对新形式的校园欺凌,学校管辖权的扩大和管制手段的革新势在必行,美国一些州在司法实践中引入"实质损害原则",同时呼吁引入旁观者责任。校园网络欺凌在我国尚处于蛰伏阶段,美国应对网络欺凌的很多策略值得我们借鉴,但前摄性言论限制和旁观者责任并不适合我国。
[Abstract]:In the United States , media reports that teenage suicide or physical and psychological harm caused by network bullying is common , and the states of the United States have already regulated the campus network bullying . The network bullying is the extension of traditional campus bullying on the network , and there are no new features . In the face of the new form of campus bullying , the expansion of school jurisdiction and the innovation of control means are imperative . In the face of the new form of campus bullying , the network bullying is still in the dormant stage , and many of the policies of the United States to deal with the network bullying deserve our reference , but the limitation of proactive rhetoric and the responsibility of the spectators are not suitable for our country .
