加拿大北极群岛水域历史性权利主张评析

【摘要】：加拿大对北极群岛水域的历史性权利主张构成了它在国际法上国家实践的重要内容,而贯穿于这一实践过程的两条主线分别是海洋法上的历史性权利和领土法上的历史性权利。前者着眼于加拿大通过立法活动对北极群岛水域行使主权或者主权权利,以及其他国家对这一行为的默认;后者立足于土著居民通过与加拿大签订领土转移协定的方式向加拿大移交北极陆地、水域和冰封区域,以及加拿大对土著居民长期占有行为的继承。由海洋法视角下加拿大主张的瑕疵和领土法视角下加拿大主张的成立,可以看出特殊的国家实践对历史性权利的构成以及对国际法发展的重要影响。
[Abstract]:Canada's historical claim to Arctic archipelagic waters constitutes an important part of its national practice in international law. The historical rights in the law of the sea and the historical rights in territorial law are the two main lines running through the process of this practice. The former focuses on the exercise by Canada of sovereignty or sovereign rights over Arctic archipelagic waters through legislative activities, as well as the acquiescence of other States to this act; The latter is based on the transfer of Arctic land, waters and frozen areas to Canada by means of a territorial transfer agreement with Canada, as well as Canada's inheritance of aboriginal occupation. From the point of view of the law of the sea, the defects of Canada's claims and the establishment of Canadian claims under the perspective of territorial law, it can be seen that the special state practice has an important influence on the constitution of historical rights and the development of international law.
