冷战后美国领事保护研究及其启示

【摘要】：自美国建国以来,美国领事保护随着国家的发展不断改进和完善。特别是在冷战结束后,两极格局的瓦解,计算机和信息技术的飞速发展为全球化的深化带来了契机。商品、资金、信息和人员在全球范围内的流动更加方便,越来越多的美国公民和企业走出国门寻求新的机遇,领事保护任务也日益繁重。为解决这一问题,美国领事保护发生了一次重大的转变。美国领事保护的工作重心从被动应对转向主动预防,工作的方式从单一实施变为多方参与。由于当下中国领事保护在发展的过程中所面临的挑战和转变与美国所面临过的挑战和转变较为相似。所以本文以美国领事保护为研究对象,一方面对美国领事保护的历史沿革进行了概述,将美国领事保护发展历史分成了三阶段进行阐述,分析了其中的变迁性和延续性,并且着重分析了冷战结束后转变的原因。另一方面对当前美国领事保护的优势和问题进行了总结,并对转变后的效果进行了评估。最后,通过对中美两国领事保护的差异分析,给予了当代中国领事保护建设一些启示性建议。
[Abstract]:Since the founding of the United States, consular protection in the United States has been improved and perfected with the development of the country. Especially after the end of the cold war, the collapse of the bipolar structure and the rapid development of computer and information technology have brought opportunities for the deepening of globalization. In order to solve this problem, consular protection in the United States has undergone a major transformation. The focus of American consular protection has shifted from passive response to active prevention. The way of work has changed from single implementation to multi-party participation. The challenges and changes in the process of development are similar to those faced by the United States. Therefore, this paper takes the United States consular protection as the research object. On the one hand, the historical evolution of the United States consular protection is summarized, and the development history of the United States consular protection is divided into three stages to elaborate, and the changes are analyzed. On the other hand, it summarizes the advantages and problems of consular protection in the United States, and evaluates the effect of the transformation. Finally, it gives some enlightening suggestions to the construction of consular protection in contemporary China by analyzing the differences between the two countries.
