从宪制运作的角度分析美国内战的发生

【摘要】：美国南北经济基础的差异决定了内战不可避免是学界主流的观点。长久以来,从美国宪制运作的角度来分析内战的发生被人忽视,事实上,制度性原因的探寻亦具相当意义。19世纪上半期,美国政治体制上出现了诸如权力配置方面的挑战,同时奴隶制议题处于美国宪政转型的中心,而立法、司法和行政各个分支在19世纪上半期的表现都应对内战的爆发有一定检讨之处。
[Abstract]:The differences in the economic base between the north and the south of the United States determine that civil war is inevitably the mainstream of the academic community. For a long time, it has been ignored to analyze the civil war from the point of view of the constitutional operation of the United States. In the first half of the 19th century, challenges such as power allocation emerged in the American political system, and the issue of slavery was at the center of the constitutional transformation in the United States. The judicial and administrative branches in the first half of 19th century should review the outbreak of civil war.
