联邦建立初期美国政治中的自由宪政秩序研究

【摘要】： 自由与宪政成为当代民主国家的主流政治价值,也是非民主国家向民主转型的方向。哈耶克指出,使国家处于一种良好的秩序中运行,来实现法律体制中的自由。从殖民时代开始,美国人对自由主义有很深刻的认识和理解。随着反对英国的殖民统治和独立战争的胜利,自由主义成为美国人根深蒂固的价值取向。美国联邦政府颁布了第一部联邦宪法,采用了代议制和分权与制衡机制,对政府权力进行限制;开国先辈并将其付诸于实践,使其体制化,捍卫了宪法的精神,夯实了作为一个自由国家的根基,把美国引向了一条良治的自由宪政之路。本文拟将以自由为出发点,通过分析联邦建立初期美国宪法政治的设计和实践,来研究其政治中的自由宪政秩序。
[Abstract]:Freedom and constitutionalism have become the mainstream political values of contemporary democracies, and they are also the direction of the transition from non-democracies to democracy. Hayek pointed out that the state is functioning in a good order. From the colonial era, Americans had a deep understanding and understanding of liberalism. With the victory against British colonial rule and the War of Independence, Liberalism became a deep-rooted value orientation in the United States. The federal government enacted the first federal constitution, which adopted a system of representation and separation of powers and checks and balances to limit the power of government; founded and put it into practice. To institutionalize it, to defend the spirit of the Constitution, to consolidate the foundation of being a free country, and to lead the United States to a free constitutional road of good governance. By analyzing the design and practice of American constitutional politics in the early days of federal establishment, this paper studies the free constitutional order in American politics.
