天津自由贸易试验区负面清单管理制度研究
[Abstract]:With the increase of foreign economic exchanges, it has gradually become an international consensus to construct a set of stable and efficient investment admission rules, and the negative list, as the core content, represents the trend of foreign capital management in the future. On the one hand, the eight-year BIT negotiations between China and the United States entered the substantive stage of "national treatment and negative list before admission" at the beginning of 2015; on the other hand, China's economic growth has slowed and the reform dividend has yet to be released. The four major free trade zones need to continue to improve. Therefore, the negative list management system is not only an important tool for our country to deal with the liberalization of international investment and construct the management mode of foreign capital with Chinese characteristics, but also the only way for our country to deepen the reform of economic system and link up the strategy of "Belt and Road". Taking Tianjin Free Trade area as a sample, this paper discusses the negative list management system from the following three parts: the first part is an overview of the negative list management system, including its concept, origin, development, legal basis and characteristics. And elaborated this system to Tianjin free trade area and even the whole country important realistic significance. The second part analyzes the current situation and deficiency of the negative list management system of Tianjin Free Trade area in detail, including the lack of legal support, the quality of the list itself, the relevant power, unclear responsibilities and so on. The third part puts forward some suggestions and measures on the negative list management system of Tianjin Free Trade area combined with foreign advanced experiences and lessons. First, to comprehensively revise the laws and regulations governing foreign investment management so that the implementation of the negative list can be justified; secondly, to improve the quality of the negative list, improve its clarity and stability, and bring it into line with international prevailing rules; and finally, to retain the right to amend the negative list, Power of interpretation, change the way of government management, clear the post-supervision responsibility in the matter.
