【摘要】： 收养制度是中国古代社会亲属关系中的一项十分重要制度，是在宗祧继承制度下对血统承续的一种拟制性补救措施，素为古代礼法所重视。它是中国封建宗法制度和传统伦理思想在家族制度上的集中体现，在维护封建宗法秩序的稳定等方面有着极为重要的作用。收养行为在原始社会末期开始出现。随着先秦时期宗法制度的确立逐渐形成以“继宗”为目的并且以“小宗可绝，大宗不可绝”、“异姓不养”等为原则的立嗣制度，作为嫡长子继承制度的一项重要补充措施。秦统一六国以郡县制取代了宗法分封制，宗族制度开始初建。秦汉承袭了“异姓不养”的原则，一直到魏晋开始出现相应法律规定。同时收养的形式开始多样化，收养的范围也有所扩大，收养目的从单一的继承宗祧也开始并重于家庭财产的继承。唐代是中国封建社会发展史上的鼎盛时期，经济、社会等各方面都在发生着重大的变化，尤其是各族的文化融合和各民族成员的互相融合形成了胡汉一体的唐代文明，，使得唐代文化具有了开放性和多元性的鲜明特点。同时唐代又处于中国封建社会的转型期，鼎盛时期的中国封建社会也逐渐暴露出种种弊端，正酝酿着许多变革的因素。古已有之的收养制度，在唐代也有了进一步的发展，表现在收养目的的多元化，收养方式的多样化，有关收养的法令手续的细化和完善，尤其是唐中后期宦官收养和藩镇假子的恶性发展，使得唐代的收养制度表现出异于前朝后代的特色。本文主要结合《唐律疏议》、唐代墓志汇编资料、史书记载及今人研究成果，在叙述唐以前收养制度发展的基础上，对唐代收养制度下的法律规定和原则、养子类型及来源、养子的法律地位以及唐后期收养制度的变化，作以客观的叙述和理性的分析，力求对唐代收养制度发展变化作以整体上的把握。
[Abstract]:The adoption system is a very important system in the family relations of ancient Chinese society . It is a kind of quasi - system remedy for the continuation of blood system under the system of clan inheritance . It is the central manifestation of Chinese feudal patriarchal system and traditional ethics thought in family system . It plays an important role in maintaining the stability of feudal patriarchal order .

In the end of the primitive society , the adoption act began to appear . With the establishment of the patriarchal clan system in the Pre - Qin period , it is an important supplementary measure of the inheritance system of the eldest son .

The Tang Dynasty is the most important period in the development history of feudal society in China . In the period of economic , social and so on , there are significant changes , especially the cultural integration of all ethnic groups and the mutual integration of the members of each ethnic group . The Tang Dynasty culture has the characteristics of openness and pluralism . At the same time , the Tang Dynasty is in the transformation period of the feudal society in China .

On the basis of describing the development of the adoption system before the Tang Dynasty , the article analyses the legal provisions and principles of the adoption system , the legal status of the adoptive son and the changes of the adoption system in the late Tang Dynasty , and tries to analyze the changes of the adoption system in the Tang Dynasty in an objective way and to make a whole grasp of the development of the adoption system in the Tang Dynasty .
