【摘要】： 本文以历史唯物主义为理论指导，运用了历史学的研究方法，对五代八个主要典章制度进行考证和分析，试图从制度的角度来看五代历史所处的独特历史地位，从而为唐宋社会的转型提供一个过渡的认识。本论文内容由前言、正文、结论三部分组成。前言部分简略地评述了学术界对五代典章制度的研究的概况，并简要地阐述了笔者对五代典章制度的基本论点、理论依据和研究方法，指出本课题在目前我国正在建构的政治文明和制度文明中的现实意义。正文分八章。第一章通过五代中央财政机构的演变及其军需职能的凸显，来论证五代赋役制度的演变，得出这种演变不仅体现鲜明的战争特点，也反映了割据因素的存在，进而提出财政格局的概念，并以此来审视五代赋役制度的实施效果及其影响，从而使五代赋役制度的演变体现了五代政治状况和经济重心南移的时代特点。第二章主要论证五代货币形态反映了五代战争和割据的状况，并通过货币制度来看五代商品经济秩序，从而论证了中原和南方商业地位的变化。第三章通过官失其职和官失其制两个角度来分析五代中央职官与君主专制的关系。五代通过对地方行政区划的调整，尤其是知州的设置，在地方官制上初步改变了唐末藩镇割据的局面。通过对五代职官制度中具有时代特点的演变进行分析，表明五代君主专制和中央集权日益加强与统一趋势不可逆转是相一致的。第四章通过五代禁军的演变论证了五代军权的日趋集中，并通过对方镇兵的演变来看五代军事形势的变化，，二者不仅体现了五代对军队的控制的逐渐加强，也体现了中央与地方军事形势发生了变化。第五章首先通过五代科举的背景分析，来看五代士人的生存环境，进而通过科举制度的演变来看五代国家科举政策的调整和士人的文化倾向，并通过士人的科举目的和手段以及出身后的社会交往的变化来看五代士风和世风。第六章通过五代宫学在唐宋之际所发生的变化，来审视其在中国古代教育史和文化史上所占有的重要地位。考证了五代国于监职能地位的升降，从而论证了国子监在五代主要扮演文化的角色；其次探究了唐代中央官学——六学二馆在五代的存废，进而阐明了五代官学日益趋向公共的特征。而以卜这些变化则表明五代在唐宋官学转型、文化重心的移易中处于枢纽的环节。第七章首先通过五代礼制的考辨来论证五代有无礼制、郊庙地点与五代两都分立和士代礼制存废状况，井以此为基础来论证礼制与五代社会等级结构的变化、礼制与五代宗族与家族地位的变迁和礼制与五代风俗的移易和渗透，从礼制的角度分析了社会结构的不同层面。五代礼制以独特的方式来引导并对社会结构的演变施加影响，与此同时，也随着社会结构的变迁付出了自身适应性转变的代价。第八章通过立法与五代武人政治的分析，论证刑统与敕是五代法律的形式和内容，井从五代法律内容中有关刑事和有关民事的法律的演变来剖析五代社会冲突的变化。通过五代司法状况的分析来确定五代法律在社会秩序中的地位，并通过五代法律思想的变化来看社会控制理论的演进。结论部分概括了论文的主要论点，指出五代典章制度的历史地位和转型的特征：申明本人在论文中的创新点；阐述了本文在当今政治文明和制度文明的建设中具有一定的现实意义。
[Abstract]:This paper, guided by historical materialism, uses the research method of history to examine and analyze the system of the five generation and eight main chapters, trying to look at the unique historical position of the five generation of history from the angle of the system, thus providing an understanding of the transition of the social transformation of the Tang and Song dynasties.
