需要原则主导还是应得原则主导——对柯亨与德沃金关于分配平等问题争论的一种考察

【摘要】：柯亨与德沃金在运气平等主义理论内部的争论涉及分配正义原则之争。柯亨不仅批判地考察了德沃金从福利平等观导向资源平等观的理论根据,而且聚焦于德沃金资源平等观"拒绝补偿奢侈偏好"的直觉性例证,从而使争论与"原则立场问题"勾连起来。正是在这种意义上,柯亨与德沃金之间的"道德与市场关系"论辩暗含着深层的原则分歧:对市场机制的不疑假设以及两类运气的区分表明,德沃金在极力避免"传统应得"原则缺陷的同时仍然诉诸一种"敏于责任"的个人应得原则,然而柯亨却意识到了这种应得原则的有限性,力图通过援引马克思的"需要原则"对应得原则提出了批评。基于此,虽然柯亨部分地肯定了应得原则,但是构成柯亨的正义理论的主导原则是需要原则。根据马克思正义原则的历史性阐释,尽管柯亨对德沃金的批评有其合理性,但是柯亨的"缺陷"也显露无遗,他不仅没有清楚地阐明需要原则的内容,而且也未能对自己所肯定的两类分配正义原则的历史性关系进行澄清。
[Abstract]:The controversy between Ke Heng and Dworkin in the theory of luck egalitarianism involves the debate on the principle of distributive justice. Ke Heng not only critically examines the theoretical basis of Dworkin's view of equality of resources from the view of equality of welfare, but also the theory of equality of resources. And focusing on the intuitive example of Dworkin's view of equality of resources, "refusing to compensate for luxury preferences," thus connecting the debate with the "position of principle." in this sense, The "moral and market relationship" argument between Khogen and Dworkin implies deep differences of principle: the assumption of market mechanism and the distinction between the two types of luck show that, While Dworkin tried his best to avoid the defects of the "traditional entitlement" principle, he still resorted to a "responsibility-sensitive" personal entitlement principle, but Kohern realized the limitation of the principle. Attempts to criticize the principle of entitlement by invoking Marx's "principle of need". Based on this, although Koheng partially affirmed the principle of entitlement, According to Marx's historical interpretation of justice principle, although Ke Heng's criticism of Dworkin is reasonable, his "defects" are also revealed. He has not only failed to clarify clearly the content of the principle of need, but also failed to clarify the historical relationship between the two kinds of principles of distributive justice which he has affirmed.
