论柏克的保守主义宪政思想

【摘要】：埃德蒙·柏克可谓是西方思想史上最重要同时又最耐人寻味的人物之一。他的思想根植于英国宪政传统和普通法传统的思想氛围之中,他在美、法革命中体现出的反差态度,使其思想看似“跨越式”的存在于当前语境之下相互对冲的意识形态之中,但究其根本,在英国特殊的历史语境下,柏克思想中保守主义与自由主义之间的意涵是一脉相承、贯彻联通的。也正因如此,柏克保守主义宪政思想揭示了“普通法心智”的内在宪政逻辑。宪政发源、成长于英美,而且一直烙印着西方现代政治基本架构的痕迹,但是柏克的宪政思想中所体现出的宪政的关键性制度元素和理念不仅仅是专属于西方社会的。如今,我国逐步迈入“立宪政治”时代,依法治国、依宪执政理念日渐深入人心,研究柏克的宪政思想不仅为我国的立宪抉择进行了知识上的储备,而且为我国的制度选择搭建了一个“普通法宪政”的模型,对于推进我国的制度建设具有一定的借鉴意义。
[Abstract]:Edmund Burke is one of the most important and intriguing figures in the history of Western thought.His thought is rooted in the ideological atmosphere of British constitutional tradition and common law tradition. His contrasting attitude in the American and French revolution makes his thought appear to be "leapfrogging" in the ideology which is opposed to each other in the current context.However, in the special historical context of England, the implication between conservatism and liberalism in Burke's thought is in the same line.It is for this reason that Burke's conservative constitutional thought reveals the inner constitutional logic of the common law mind.The origin of constitutionalism grew up in Britain and America, and it has always imprinted the trace of the basic structure of western modern politics, but the key institutional elements and ideas of constitutionalism embodied in Burke's constitutional thought are not only exclusively belong to the western society.Nowadays, our country has gradually entered the era of "constitutional politics", governing the country according to law and governing by the constitution, the idea of governing according to the constitution is becoming more and more popular. The study of Burke's constitutional thought has not only made a reserve of knowledge for the constitutional choice of our country.Moreover, a model of "common law constitutionalism" is built for our country's system choice, which has certain reference significance for promoting our country's system construction.
