公平与契约主义

【摘要】：在17和18世纪,契约主义在西方政治哲学中处于统治地位。然而,到了19世纪初,契约主义突然死亡,其支配地位被功利主义取而代之。自20世纪70年代以来,契约主义又开始死灰复燃。导致契约主义死亡以及重生的原因是什么?从理论上来说,最重要的原因是公平。首先,古典契约论之所以死亡,其原因在于所达成的契约是不公平的;其次,在满足公平的条件下,契约主义能够发展出更合理的形式;最后,以公平为尺度,我们可以区分出两种契约主义,即霍布斯式的契约主义和罗尔斯式的契约主义。
[Abstract]:In the 17 th and 18 th centuries, contractualism was dominant in western political philosophy. By the beginning of the 19 th century, however, contractualism suddenly died and its dominance was replaced by utilitarianism. Since the 1970 s, contractualism has returned to life. What are the causes of indentured death and rebirth? In theory, the most important reason is fairness. First, the reason for the death of classical contract theory lies in the fact that the contract reached is unfair; secondly, under the condition of equality, contractualism can develop a more reasonable form; finally, by the criterion of fairness, We can distinguish two kinds of contractualism, namely Hobbesian contractualism and Rawls indentarianism.
