天一阁藏明抄本《官品令》考

【摘要】：本文对宁波天一阁所藏明抄本 《官品令》进行了考证， 认为此书正是久已湮没的宋代法律典籍 《天圣令》。作者详细考证了这部残存令典的体例、篇目以及它所保存的 《唐开元二十五年令》原文， 指出这个残本的发现不仅对了解北宋的典章制度和人口等问题具有重要参考价值，而且对于唐史研究，尤其是唐令的研究和复原工作具有极为重要的意义。在唐宋 ６００ 多年历史中， 统治者曾修纂过无数部法律典籍。然而， 除了我们今天所能看到的 《唐律疏议》、《宋刑统》和 《庆元条法事类》外， 似乎全都失传无闻。最近，， 我因整理点校 《庆元条法事类》而翻阅 《中国古籍善本书目》， 在史部职官类中见到一条著录曰： “《官品令》三十卷， 明抄本， 存十卷， 二十一至三十。”这引起了我的兴趣。根据法律史常识判断， 此书不会是明代所撰， 很有可能是唐宋时期的法律典籍。通过朋友的帮助， 我在宁波天一阁博物馆翻阅了此书。
[Abstract]:In this paper, the author makes a textual study of the official order of the Ming Dynasty, a copy of the Tianyi Pavilion in Ningbo, and holds that this book is the ancient book of the Song Dynasty which has been buried for a long time.The author makes a detailed study of the style, contents and original text of Tang Kaiyuan 25, and points out that the discovery of this remnant not only has important reference value for understanding the rules and regulations of the Northern Song Dynasty, but also for the population, etc.Moreover, it is of great significance for the study of Tang history, especially the research and restoration of Tang Ling.In the 600-year history of the Tang and Song dynasties, the ruler had compiled numerous books of law.However, except for what we can see today, such as Tang Law, Song Criminal system and Qingyuan Law, they all seem to have been lost.Recently, because of sorting out "Qingyuan articles and legalities", I went through the "Chinese Ancient Books and good Books Bibliography." I saw a description in the official category of the History Department, saying, "the official articles order is thirty volumes, Ming transcripts, ten volumes, 21 to thirty."This aroused my interest.Judging from the common sense of legal history, this book is not written by the Ming Dynasty, but probably from the Tang and Song dynasties.With the help of my friends, I read this book at the Tianyi Pavilion Museum in Ningbo.
