我国非婚同居法律规制研究

【摘要】：随着社会经济不断发展和人们思想不断解放,公众对婚姻的认识呈现多样化,对同居的接受程度越来越高。随之,非婚同居在这种社会大环境下发展起来,尤其是到二十世纪九十年代迅速流行起来。非婚同居关系既满足了人们自由选择生活方式的要求,又缓解了现实婚姻带来的资金压力。但是,随着非婚同居的不断发展,该现象也引起了诸多社会问题,应给予充分的重视。另外,在中国民法学研究会2016年年会上,徐涤宇教授提出在民法典编纂过程中要对不断发展的非婚同居现象给予重视,非婚同居现象再次引起大家的注意。借着民法典编纂的契机,为了适应非婚同居的发展要求并解决由其引起的诸多社会问题,通过法律对其进行规制成为亟需解决的问题。在非婚同居法律规制问题上,我国虽然取得了一些进展,但是仍然有很多问题亟待解决。现今,在立法上,我国法律对非婚同居问题仍采取一种“不承认,不支持,不干预”回避的态度,并没有给予明确规定;在司法上,我国最高人民法院虽然出台了相关意见和司法解释,但是依然存在很多漏洞和不足。通过运用价值分析法、比较分析法、历史分析法的研究方法,我们充分论述我国非婚同居法律规制立法和司法现状,从而找出在立法和司法上存在的一系列问题。找出问题的最终目的是解决问题。针对非婚同居法律规制立法和司法所存在的问题,借着民法典编纂的契机,我们创新性的提出非婚同居法律规制的立法和司法建议,期待更好的解决非婚同居所引起的矛盾纠纷。针对如何解决非婚同居法律规制所面临的问题,我们可以从立法和司法两方面具体提出解决方案。在立法上,我们要紧紧抓住民法典编纂的机遇并顺应社会发展的需要,将非婚同居写入民法典,建立完善的非婚同居法律制度。该法律制度要对非婚同居的成立、人身关系、财产关系、亲子关系和非婚同居的解除等方面进行明确规定,从而把非婚同居列入到法律规制范围内,为解决非婚同居所引发的问题提供法律依据。在司法上,我国要出台一系列司法解释和指导性案例,并加强对弱势群体的保护力度。通过落实这些司法措施,在司法领域,我们可以更好的对非婚同居进行法律规制。我国将非婚同居纳入法律规制的范围内,顺应了社会发展的要求,既可以保护非婚同居者双方的利益,又可以解决非婚同居所面临的一系列问题。期待该研究能对非婚同居法律规制有所贡献。
[Abstract]:With the continuous development of social economy and the continuous liberation of people's thoughts, the public's understanding of marriage is diversified, and the acceptance of cohabitation is getting higher and higher. As a result, unmarried cohabitation has developed in this social environment, especially in 1990s. The unmarried cohabitation not only satisfies the demands of people's free choice of life style, but also relieves the financial pressure brought by real marriage. However, with the continuous development of non marital cohabitation, this phenomenon has also caused many social problems, and should be given full attention. In addition, at the 2016 annual meeting of China Civil Law Research Association, Professor Xu Diyu proposed that we should pay attention to the phenomenon of unmarried cohabitation in the process of compiling the civil code, and the phenomenon of unmarried cohabitation attracted everyone's attention again. With the opportunity of compiling the civil code, in order to adapt to the development requirement of unmarried cohabitation and solve many social problems caused by it, it is urgent to regulate it by law. Although some progress has been made in the legal regulation of unmarried cohabitation, there are still a lot of problems to be solved. Now, in the legislation, the law of our country is still unmarried cohabitation problems take a "do not admit, do not support non intervention" evasive attitude, and did not give clear; in judicial practice, the Supreme People's Court of China has introduced some relevant opinions and judicial interpretation, but there are still many loopholes and shortcomings. By using the research methods of value analysis, comparative analysis and historical analysis, we fully discuss the current situation of legislation and judicial regulation of unmarried cohabitation in China, so as to find a series of problems in legislation and judicature. The ultimate goal of finding out the problem is to solve the problem. Aiming at the existing problems of legislation and judicature in the regulation of unmarried cohabitation, by innovating the legislative and judicial suggestion of the legal regulation of unmarried cohabitation, we hope to better solve the contradictions and disputes caused by unmarried cohabitation. In view of how to solve the problems faced by the legal regulation of unmarried cohabitation, we can put forward the solutions from two aspects of legislation and judicature. In legislation, we must seize the opportunity of compiling the civil code and comply with the needs of social development. We will integrate the unmarried cohabitation into the civil code, and establish a perfect unmarried cohabitation legal system. The legal system should be established for unmarried cohabitation, personal relations, property relations, parent-child relationship and cohabitation termination etc. were clearly defined, so the scope of legal regulation of unmarried cohabitation in, provide a legal basis for solving the problems caused by non marital cohabitation. In the judiciary, our country should introduce a series of judicial interpretations and guiding cases, and strengthen the protection of the vulnerable groups. Through the implementation of these judicial measures, in the field of justice, we can better regulate the law of non marriage cohabitation. China's incorporation of unmarried cohabitation into the scope of legal regulation complies with the requirements of social development. It can not only protect the interests of the unmarried cohabitation, but also solve a series of problems faced by unmarried cohabitation. It is expected that the study will contribute to the legal regulation of unmarried cohabitation.
