【摘要】:不动产登记制度是我国民事法律制度的重要组成部分,《物权法》设专章对其进行规定,就可见一斑,其更首次在立法层面上规定了不动产登记错误的损害赔偿责任。然而物权法对不动产登记错误损害赔偿的规定,更多的是原则性的规定,就其价值而言,更多的停留在宣誓的层面,《不动产登记暂行条例》(以下简称为《暂行条例》)第五章为法律责任,然而却仅有四个条文,对不动产登记机构错误登记的赔偿责任规定尚有不足,需要立法予以明确之处不少。本文分为四章:第一章分析了我国在不动产登记赔偿责任的条文规定方面存有的三个不足之处:在不动产登记机构审查模式的规定方面,《暂行条例》及其实施细则之规定缺乏可操作性,没有构建完善的形式审查配套措施。在赔偿责任认定方面,未明确赔偿责任的性质以及赔偿的法律救济途径,不动产登记赔偿责任的归责原则规定不明确;在赔偿责任承担方面,错误登记导致的赔偿范围不明确,不动产登记赔偿责任的归责原则规定不明确。第二章探讨了不动产登记的审查方式,这是确定不动产登记机构承担赔偿责任的前提。本文认为我国应该选择审慎形式审查模式,并分析了采纳该审查模式的理由以及进行审慎形式审查的具体标准。基于形式审查本身对安全的保障功能较弱,本文认为可以配套规定强制公证制度,以此实现构建形式审查与配套措施相结合的完善的不动产登记审查制度。第三章,对不动产登记机构赔偿责任的认定,首先需要明确不动产登记机构赔偿责任的性质,本文从四个角度论述其应为民事赔偿责任,然后分析了不动产登记机构赔偿责任的归责原则,考察关于登记机构赔偿责任归责原则的不同观点后,认为我国《暂行条例》对此未予规定,应适用《物权法》的规定,将登记机构赔偿责任的归责原则确定为无过错责任原则。第四章主要讨论我国不动产登记机构赔偿责任的承担,首先考察了域外关于不动产登记机构赔偿范围的不同规定模式,进而综合考虑提出观点,认为我国赔偿范围应采取全额赔偿。由于登记机构承担无过错责任,且需进行全额赔偿,故赔偿资金的来源保障就显得尤为重要,本文在分析各种赔偿资金来源的利弊得失基础上,结合我国现阶段的实际情况,探讨我国赔偿资金应该采取的来源途径。

The second chapter discusses the real estate registration review, which is the premise to determine the real estate registration institution shall be liable for compensation. This paper argues that our country should choose the form carefully review mode, and analyses the specific standards adopted the review mode and the reason for careful review form. The form of review itself on the security function is weak based on the regulations mandatory notarization system, in order to The construction of formal examination and supporting measures of the combination of the perfect real estate registration system. The third chapter, on the real estate registration agency finds liability, we should make clear the real estate property registration agency liability, this paper from four aspects which should be civil liability, and then analyzed the real property registration agency liability imputation principle, the effects of different views on the registration principle of liability, that the Provisional Regulations of China < > declined provisions should be applicable provisions of "property law", the principle of determining liability of the registration agency liability is no fault liability principle. The fourth chapter the discussion of China's real estate registration compensation liability, first inspects the extraterritorial about real estate registration provisions of different scope of compensation mechanism, and considering that China put forward viewpoint, the scope of compensation should be Take full compensation. Because the registration authorities bear the liability without fault, and the need for full compensation, the compensation funds source of security is particularly important, based on the analysis of the advantages and disadvantages of various source of funds for compensation on the basis of combining with the actual situation in our country, to explore the sources of our compensation funds should be taken.
