行政诉讼立案制度研究

【摘要】：立案是公民进入司法领域的第一道防线,其设置科学与否关系到公民的诉权保障,公民的实体权益能否得到更好的实现。立案登记制度作为我国新的立案制度在司法实践中是否起到更好的保障,是否能解决我国行政诉讼“立案难”的问题。本文通过对立案登记制度所涉及的理论问题进行剖析,介绍我国立案制度的现状,分析英、法两国的立案制度,提出建议对我国立案登记制度加以完善。全文由五个部分组成。第一部分对我国行政诉讼立案制度加以概述,先通过对行政诉讼立案制度的发展历程介绍,引出行政诉讼立案登记制度,然后通过现行的法律规定描述立案登记制度在司法实践中应当呈现出来的样子,为分析下文做铺垫。第二部分主要探讨立案登记制度所涉及的理论基础,即行政诉权理论和诉讼效率理论,通过对理论的研究,借以寻求行政诉讼立案制度应达到的社会效果,可以更好的完善制度的设计。第三部分主要是对我国现行的行政诉讼立案制度的现状进行介绍,首先列举我国立案登记制度立法的相关规定,其次介绍立案登记制度司法实践状况,最后揭示目前出现的“诉权未得到保障”、“诉讼爆炸”、“缠诉、滥诉”等问题。第四部分主要是从比较法的角度对英、法两国的相关制度进行了考察,通过诉讼当事人、诉讼标准、诉讼条件、诉讼方式等对两国相关制度进行详细深入的分析,借鉴其中的有益经验,启示着我国我国的立案登记制度。最后一部分是提出通过设计要素核查制以及建立恶意诉讼信息库等方法来完善我国现有的立案登记制度。
[Abstract]:On the first line of defense is to enter the field of its citizens, set up science and not related to the citizen's right of action, civil substantive rights can get a better implementation of the registration system in our country. As a new filing system is to better safeguard in the judicial practice, whether can solve the difficult filing of administrative litigation in China "the problem. This paper analyzes the theoretical issues involved in the registration system, introduces the status quo, filing system in China analysis of the English and French, filing system, some suggestions on China's registration system be perfect. This thesis consists of five parts. The first part of China's administrative litigation filing system. The first, through the course of development of the administrative litigation filing system, leads to administrative litigation registration system, and then through the existing legal provisions to describe the registration system in judicial practice Should show the way, to pave the way for the following analysis. The second part mainly discusses the theoretical basis of the registration system to the administrative litigation theory and litigation efficiency theory, based on the theoretical study, in order to seek administrative litigation filing system should meet the social effect, can better improve the system design. The third part mainly is the current status of the administrative litigation filing system were introduced, China's first listed on the relevant provisions of the legislation of the registration system, followed by the introduction of registration system of judicial practice, finally revealing the "right of action is not guaranteed", "litigation explosion", "wrapped around the lawsuit, lawsuit abuse problem". The fourth part is mainly from the perspective of comparative law, investigated the related system of France, the litigant, litigation, litigation, litigation and so on two phase A detailed and in-depth analysis of the system is done, and some useful experiences are drawn from it, which enlightens our country's registration system. The last part is to improve our existing registration system through the design elements verification system and the establishment of malicious lawsuit information base.
