【摘要】:学界对于劳动合同法定变更的问题尚缺乏系统研究,认为劳动法中存在法定变更的学者也不多见。这促使笔者从学理和法律规定两个角度对劳动合同法定变更制度进行研究和解读。本文就以保护劳动者合法权益为立足点,从民法和劳动法的基本法理出发,分析如何理解和把握劳动合同法定变更制度,其中的关键在于两项创新之处。一是理论上的创新,本文首先明确提出,基于实质正义的要求,劳动合同法定变更的概念于理应当存在,并运用逻辑学中的定义规则对这一概念作出了定义,探讨了其具有法定性、合意性、法律后果的多重性与立法目的的社会性等特点,认为其应当被定性为用人单位的义务、劳动者的权利,且劳动者所享有的该项权利在权能形式上表现为请求权,需通过对方或他方协力方可实现。二是实践上的创新,分为两个部分,第一个部分是对于法律规定的分析,本文将现行劳动法律法规中有关劳动合同法定变更的规定进行了梳理,归纳出法定变更的两种类型共十种情形,总结了法定变更需满足书面变更的形式要件与双方存在劳动合同关系、变更事由符合法律规定、当事人存在有效变更行及变更内容明确四项实质要件,并且双方当事人应当按照达成合意的程序进行变更;第二个部分是关于法律后果的探讨,在义务未得履行、变更的形式要件或实质要件不满足及程序违法等致使变更不成的情况下,当事人需承担何种法律后果。
[Abstract]:There is no systematic research on the legal change of labor contract in academic circles. There are few scholars who think that there are legal changes in labor law. This urges the author to study and interpret the legal change system of labor contract from the angle of theory and law. This paper focuses on the protection of the legitimate rights and interests of workers. A foothold. Starting from the basic legal theory of civil law and labor law, this paper analyzes how to understand and grasp the legal change system of labor contract, the key of which lies in two innovations. Based on the requirement of substantive justice, the concept of legal change of labor contract should exist, and the definition rules in logic are used to define the concept, and to discuss its legal nature and agreement. The characteristics of the multiple legal consequences and the sociality of the legislative purpose should be characterized as the obligation of the employer and the right of the laborer, and the right enjoyed by the laborer is manifested as the right of claim in the form of power. The second is the innovation in practice, which is divided into two parts, the first part is the analysis of the legal provisions. In this paper, the current labor laws and regulations on the statutory changes of labor contracts are combed, and two types of legal changes are summed up in ten situations. Summarized the legal changes to meet the formal requirements of written changes and the existence of labor contract relationship between the two parties, the change subject matter in accordance with the law, the parties to the effective change line and change content clear four essential elements. And the parties shall make changes in accordance with the agreed procedure; The second part is the discussion about the legal consequences. What kind of legal consequences should the parties bear if the obligation has not been fulfilled, the formal or substantive elements of the change are not satisfied and the procedure is illegal.
