【摘要】：2013年12月,第九届部长级会议在印度尼西亚的巴厘岛举行。在此次会议上,WTO成员最终就《贸易便利化协定》达成一致,它成为“巴厘一揽子协定”的重要组成部分,对于国际经济与贸易具有重大的影响和深远的意义。我国早在2014年就完成了国内批准手续,但《贸易便利化协定》一直没有达到生效条件。直至2017年2月22日,卢旺达、乍得、阿曼和约旦四个成员提交了《协定》批准书,至此接受该协定的成员已达112个,达成了超过三分之二成员接受的生效条件,《贸易便利化协定》正式生效。《贸易便利化协定》的生效与实施对我国具有巨大的意义:一来可以减少进出口障碍,改善通关环境;二来促进了口岸建设,改善口岸的综合治理体系;三来可以提高我国以及“一带一路”沿线国家和地区的贸易便利化水平,对“一带一路”规划中的“贸易畅通”的实现大有助益。正因该协定的重大作用才选定这一题目并且用四个章节对《贸易便利化协定》进行解析。第一章是引言,主要介绍了选题背景和意义、国内外研究现状以及本文的研究方法和创新点,这一部分是论文正式书写前的关键步骤。选题背景和意义可以凸显出对《贸易便利化协定》的研究是有价值的,国内外研究现状可以了解到我国和外国的专家学者对于《协定》生效前贸易便利化问题以及生效之后的改革措施等问题的一些观点和看法,最后的研究方法和创新点对于《贸易便利化协定》的分析和建议有一定的指导作用。第二章是《贸易便利化协定》的概述,主要分三节,包括《协定》的涵义、产生背景和主要内容。首先对“贸易便利化”一词的概念进行了界定,列举了一些国际上对该词的定义,通过贸易便利化与贸易自由化的区别分析以及三大原则的阐述更好的了解了这一词。其次对《贸易便利化协定》的产生背景做了介绍,尤其是分阶段的介绍了它的谈判历程,了解《协定》达成的不易。最后重点介绍了《贸易便利化协定》的主要内容,因为其目的是对GATT1994的澄清和改善,因此采用了对比研究的方法将他们的内容进行的比较,更加了解了《贸易便利化协定》的内容和优点。第三章是中国推进贸易便利化改革的的实践和障碍。在第一节,因为在《协定》生效前,我国为了提高贸易便利化水平已经开始进行的改革,并且取得了一些成果,如风险管理制度、大通关制度、单一窗口制度等,但是我们要从这些成果中看到不足,所以在第二节采用调研法和数据分析法,在实践中找出我国在改革遇到的障碍,本文从四个方面阐述了这一问题,分别是:缺乏统一完整的制度体系,制度实施不到位,信息技术有待提高以及贸易便利化制度的差异性。第四章是对《贸易便利化协定》促进贸易便利化改革的建议。如今《协定》生效,必然会对我国的贸易便利化改革产生影响,对它今后的实施就是重要的研究方向。因此本文针对改革中面临的障碍提出了一些四条建议,分别是:完善贸易便利化制度体系,增强贸易便利化执法水平,提升信息技术与能力水平,加强国际合作促进协同发展。采用了案例分析法和数据分析法,对每条建议进行了详细的阐述。
[Abstract]:In December 2013, the ninth session of the Ministerial Conference held in Indonesia, Bali Island. During the meeting, members of the WTO finally agreed to "trade facilitation agreement", it has become an important part of "Bali package of agreements and has a great influence and profound significance for the international economy and trade. China as early as 2014 completed the domestic approval procedures, but the" trade facilitation agreement "has not reached effective conditions. Until February 22, 2017, Rwanda, Chad, four members of the Oman and Jordan submitted the agreement approved by the book < >, so accept members of the agreement reached 112, reached more than 2/3 members to accept the conditions of effectiveness, effective trade" facilitation agreement came into effect. The background and significance of research can highlight on" trade facilitation in accordance with the agreement is valuable, the research status at home and abroad can learn some ideas after experts and scholars in China and foreign to the agreement before < > effect of trade facilitation and effective reform measures. And the view, analysis and suggestions for "trade facilitation agreement in accordance with the research methods and innovation finally has a guiding role. The second chapter is an overview of trade facilitation agreement > >, it is divided into three sections, including < > agreement the meaning, background and main content. Finally the paper introduces the main contents of trade facilitation agreement", because its purpose is to clarify and improve GATT1994, therefore using the methods of comparative research, their content Comparison of a better understanding of the content and advantages of "trade facilitation agreement". The third chapter is the practice of and barriers to promote trade facilitation reform of the China. In the first section, because the agreement came into effect in < >, reform of our country has begun to improve the level of trade facilitation, and achieved some results. Such as the risk management system, customs clearance system, single window system, but we want to see results from these deficiencies, so used in section second investigation and data analysis, find out the reform in our country's obstacles in practice, this paper from the four aspects of this problem are: lack of system a unified system, the implementation of the system is not in place, the difference of information technology needs to be improved and the trade facilitation system. The fourth chapter is on "trade facilitation agreement on trade facilitation reform proposals. This paper aiming at the obstacle faced in the reform and puts forward some suggestions are: four, improve trade facilitation system, enhance trade facilitation level of law enforcement, improve information technology and ability.
