【摘要】：禁止重复评价原则根植于法的正义性价值,在刑法理论研究与司法实务中均应是一项十分重要的原则,然而我国刑事立法并没有将禁止重复评价原则明确规定,学理上关于禁止重复评价原则的研究渐多但尚浅。禁止重复评价原则既是一项定罪原则又是一项量刑原则,在刑法评价全过程应当具有应用的生命力与前沿性。本文以禁止重复评价原则在定罪与量刑中的不同表现为出发点,通过禁止重复评价原则对我国刑事司法实务的现状进行反思,论述禁止重复评价原则对定罪和量刑工作指导作用,阐明禁止重复评价原则在我国刑事司法中应当具有的地位。本文共分为以下五个部分:第一部分介绍禁止重复评价原则既是一项定罪原则,也是一项量刑原则,该原则起始于古罗马法,并经英美法系和大陆法系各国立法中不同的规定而完善、成熟,蕴含着法的正义性、罪刑法定原则与罪刑均衡原则等价值理论基础。第二部分介绍禁止重复评价原则在定罪中的贯彻及不足,这一原则能与构成要件理论共同解决对罪数的理解问题,但在一罪内部构成中,禁止重复平原则的应用不足会对情节犯和数额犯的认知陷入误区。第三部分介绍禁止重复评价原则在量刑中的缺失状况。首先,概括论述对禁止重复评价原则的不当理解造成的量刑环节出现指引缺失的问题;其次,以禁止重复评价原则评析司法实践中重复使用量刑情节的问题;最后,通过刑罚执行完毕后对余罪的处理这一细节问题,综合讨论量刑中违背禁止重复评价原则的表现和后果,反思我国目前的量刑思路和制度。第四部分介绍对禁止重复评价原则在我国定罪量刑全过程中具体规则的设计。承接前两个部分的论述,明确禁止重复评价原则对定罪与量刑具体的指导作用,通过禁止重复评价原则建立定罪与量刑的具体规则。第五部分介绍与定罪量刑相关的不可罚的前后行为与外国刑事判决的承认和执行,将其纳入禁止重复评价研究的思考中。
[Abstract]:The principle of prohibiting repeated evaluation is rooted in the justice value of law, which should be a very important principle in the theoretical research of criminal law and judicial practice. However, the principle of prohibiting repeated evaluation is not explicitly stipulated in Chinese criminal legislation. In theory, there are more and more researches on the principle of prohibiting repeated evaluation. The principle of prohibiting repeated evaluation is not only a principle of conviction but also a principle of sentencing. In the whole process of criminal law evaluation should have the vitality and the front-line. This article to prohibit the principle of repeated evaluation in the conviction and sentencing of different performance as the starting point. Through the prohibition of repeated evaluation of the principle of criminal justice practice in China to reflect on the status quo, discusses the prohibition of repeated evaluation of the principle of conviction and sentencing guidance. This article is divided into the following five parts: the first part introduces the prohibition of repeated evaluation principle is not only a conviction principle, but also a sentencing principle. This principle originated from ancient Roman law and was perfected by different provisions in the legislation of Anglo-American law system and civil law system. It is mature and contains the justice of law. The second part introduces the implementation and deficiency of the prohibition of repeated evaluation principle in the conviction. This principle can solve the problem of understanding the number of crimes together with the theory of constitutive elements, but in the internal constitution of a crime. The lack of application of the prohibition of the principle of repetition will fall into a misunderstanding of the circumstances of crime and the amount of crime. The third part introduces the lack of prohibition of repeated evaluation in sentencing. First of all. Discuss the problem of the lack of guidance on sentencing link caused by the improper understanding of the prohibition of repeated evaluation principle; Secondly, to analyze the repeated use of sentencing circumstances in judicial practice with the principle of prohibiting repeated evaluation; Finally, through the punishment after the execution of the residual crime after the handling of this detail, comprehensive discussion of sentencing against the principle of repeated evaluation of the performance and consequences. Part 4th introduces the design of the specific rules of the prohibition of repeated evaluation principle in the whole process of conviction and sentencing in China. Clear prohibition of repeated evaluation of the principle of conviction and sentencing specific guidance role. Through the prohibition of repeated evaluation principle to establish the conviction and sentencing of specific rules. Part 5th introduces the conviction and sentencing related to the non-punishable behavior and the recognition and enforcement of foreign criminal sentences. To put it into the thinking of the research on the prohibition of repeated evaluation.
