【摘要】：保护作品完整权是一项重要的著作人格权,世界上大多数国家及《伯尔尼保护文学艺术作品公约》(以下简称为“《伯尔尼公约》”)都规定了该权利。相对于其他国家来说,我国《著作权法》对保护作品完整权的规定比较简单,理论界和实务界对该权利存在较多争议,相关制度也有待完善,因此,很有必要对其进行深入的分析。本文对相关理论,国内外著作权法律制度及其实践,特别是我国2012~2016年涉及保护作品完整权侵权纠纷的司法判决书等进行分析研究,旨在完善我国保护作品完整权法律制度,并推动我国在该领域的理论研究。本文分引言、正文和结论三个部分。其中,正文分为三章,内容如下:第一章为保护作品完整权的基础理论研究,主要分析保护作品完整权的基本概念,保护作品完整权的起源与发展,保护作品完整权的正当性以及保护作品完整权的性质四个方面的问题。保护作品完整权的概念部分主要阐述的是我国法律中该权利的基本概念,同时也指出了我国《著作权法》对该权利规定的模糊性。保护作品完整权的起源与发展这一部分,主要是有关该权利在以法国和德国为代表的作者权体系国家的产生,在《伯尔尼公约》中的确立以及在以美国和英国为代表的版权体系国家的被动接受的研究。保护作品完整权的正当性这一部分从黑格尔的人格理论、激励论以及经济学的成本收益理论的角度对设置保护作品完整权的必要性进行思考。保护作品完整权的性质部分则从保护作品完整权在民法上属于人格权的层面进行探讨。第二章为保护作品完整权实证分析。这一部分对保护作品完整权展开了实证研究,选取了我国2012~2016年5年间北大法宝数据库所有与保护作品完整权侵权相关的司法案例,并对其进行了整理、归类、分析,从中总结了法院对保护作品完整权与修改权的关系、法人作为保护作品完整权主体、保护作品完整权转让、保护作品完整权侵权判定标准及救济方式以及保护作品完整权的限制等问题的态度。从这些态度中发现的问题将在第三章通过分析和论述得到解决,某些观点也将会作为论述的例证。第三章是对我国保护作品完整权法律制度完善的探讨,主要从以下几个方面展开:保护作品完整权与修改权的关系,法人作为保护作品完整权主体的合理性,保护作品完整权转让、继承和放弃的不合理性,保护作品完整权的侵权判定标准及救济方式以及保护作品完整权限制制度。这些角度与第二章从司法案例中总结的角度相对应。在得出每一问题的结论后,文章在此基础之上,对我国《著作权法》及《著作权法实施条例》相关内容提出了具体的修改建议,主要包括:应当彻底删除修改权的内容、明确法人能够作为保护作品完整权的主体,明确保护作品完整权不得转让、放弃,明确保护作品完整权的侵权判定标准与救济方式,以及增加对保护作品完整权限制的相关规定。
