论网络消费者权益的法律保护

【摘要】:近年来,随着互联网的发展和电子科技的进步,网络购物已然成为一种新兴的消费方式。我国的网络购物市场发展极其迅速,交易规模翻番,越来越多的消费者参与到网络购物中。消费者通过网络给自己的生活带来更多便利,与此同时,一些网络购物纠纷也不可避免的随之出现,如卖家提供虚假信息、支付货款后卖家不发货、退换商品困难等。面对频繁发生的网络购物纠纷,如何规范网络交易市场,促进网络交易健康发展,维护网络消费者的正当权益已经成为亟待解决的问题。 本文首先分析了网络购物中侵害消费者权益的类型。逐类分析消费者的安全权、隐私权、知情权、公平交易权、索赔权是怎样被侵害的。接下来剖析网络购物消费者权益受损的原因。究其实质,产生消费者权益保护问题的根由在于网络消费的特殊性,即网络消费中更易发生信息不对称,进而消费者权益更容易受侵害。同时相关法律制度不完善、救济机制缺失、消费者与经营者经济和社会地位的不平等也是造成网络购物维权困难的主要原因。其次研究境外立法的经验并从中发掘对我国的启示。欧盟、美国、德国、日本等发达国家电子商务较之我国起步较早,在法律规定以及制度的建立上已走过不少的弯路,并且积累了许多经验。其对信息披露明确性的规定、消费者无条件撤销权的确定、在线纠纷统一管辖的规定都有力的保护了消费者的个人利益。国外的立法经验可以借鉴使用,但不能盲目的进行法律的移植,充分考虑我国国情。最后指出我国现行法律制度对网络消费者权益保护的不足,并提出完善建议。通过分析我国网络消费者权益保护的立法现状,发现现行立法的不足,在法律制度、行政监管、.行业自律、网络信用系统的建立等方面提出完善建议。
[Abstract]:In recent years, with the development of the Internet and the progress of electronic technology, online shopping has become a new consumption mode. More and more consumers participate in online shopping. Consumers bring more convenience to their lives through the Internet. At the same time, some online shopping disputes inevitably appear, such as sellers provide false information. In the face of frequent online shopping disputes, how to standardize the online trading market and promote the healthy development of online transactions, Safeguarding the legitimate rights and interests of network consumers has become an urgent problem to be solved. This paper first analyzes the types of consumers' rights and interests in online shopping. It analyzes consumers' rights to security, privacy, information, fair trade, etc. How the right of claim is infringed. Next, analyze the reason why the rights and interests of consumers in online shopping are damaged. In essence, the root cause of the problem of consumer rights and interests protection lies in the particularity of network consumption, that is, information asymmetry is more likely to occur in network consumption. Moreover, consumers' rights and interests are more vulnerable to infringement. At the same time, the relevant legal system is not perfect, and the relief mechanism is missing. The inequality between consumers and operators' economic and social status is also the main reason for the difficulty of online shopping rights. Secondly, we study the experience of overseas legislation and explore the enlightenment to our country. The European Union, the United States, Germany, the European Union, the United States, Germany, the European Union, the United States, Germany, The electronic commerce of Japan and other developed countries started earlier than that of our country, and they have already gone through a lot of detours in the establishment of laws and regulations, and accumulated a lot of experience. The determination of consumers' unconditional right of rescission and the provisions of unified jurisdiction over online disputes have effectively protected the personal interests of consumers. Foreign legislative experience can be used for reference, but the transplantation of laws cannot be blindly carried out. Finally, it points out the deficiency of the current legal system of our country to the protection of network consumers' rights and interests, and puts forward some suggestions to perfect it. By analyzing the current legislative situation of the protection of network consumers' rights and interests in our country, we find out the shortcomings of the current legislation. In the legal system, administrative supervision, industry self-discipline, the establishment of network credit system, put forward some suggestions.
