【摘要】：2015年11月30日,法国巴黎召开了《联合国气候变化框架公约》第21次缔约方会议,经过12天的讨论,《巴黎协议》最终获得通过。该协议凝结了国际社会在应对全球气候变化问题上最广泛的共识,彰显了国家利益和国际利益的均衡,是全球改善气候变化问题进程的里程碑事件。文件共29条,包括应对全球气候问题多层面和多角度的内容,尤其是共同但有区别责任原则的应用进一步得到了发展。该原则是国际环境法领域的基本原则,坚持共同但别责任原则是加强全球气候变化进程中国际合作的坚实基础。共同但有区别责任原则的发展过程就是该原则的应用过程,该原则产生的理论基础和实践基础,决定了该原则必须顺应时代的发展,因此持续关注该原则的发展变化是十分必要的。本文以应对全球气候变化为背景,主要针对《巴黎协议》中共同但有区别责任原则的发展内容进行研究,分析共同但有区别责任原则的发展特点,对该原则在发展过程中我国面临的挑战进行总结,并提出相应对策。本文总共分为五个部分,按照引言、概述、理论基础、新发展以及挑战与应对的顺序进行阐释,具体内容设置如下:第一章引言部分,首先,从文章的选题着手,介绍共同但有区别责任原则得以发展的国际背景,探究该原则发展的现实意义,从论文研究的目的出发阐明研究价值;其次,介绍国内和国外有关共同但有区别责任原则的研究成果,为选题的研究提供方向,为论文的撰写提供素材;最后,总结研究方法,归纳创新内容。第二章概述部分,分别从共同但有区别责任原则的内涵、历史背景和历史进程对该原则进行阐释,关于该原则历史进程的部分,结合相关的国际条约将该原则的历史发展进程划分为萌芽、确立、应用和发展四个阶段,理顺该原则的发展过程。第三章理论基础部分,首先,共同但有区别责任原则产生的法学理论,从可持续发展理论、公共信托理论和污染者付费三个方面进行介绍;其次,对该原则产生的伦理学理论进行介绍,主要介绍非人类中心主义和环境正义理论对该原则产生的影响;最后,以外部经济理论为研究中心,阐释该原则产生的经济学理论。第四章是介绍共同但有区别责任原则在《巴黎协议》中的新发展。首先,探究该原则在内涵上的丰富与发展;其次,以该原则的具体应用为着手点,探究该原则的发展内容,从国家自主贡献模式、资金援助机制的操作性和行动和支助透明度的监督机制为中心进行探究;再次,梳理共同但有区别责任原则的国际合作基础,从合作依据、合作主体、合作利益和合作模式四个方面,探寻新的国际背景下的国际合作关系;最后,对共同但有区别责任原则的发展特点进行归纳,总结《巴黎协议》赋予该原则的新意义。第五章是我国在共同但有区别责任原则的发展过程中面临的挑战与应对。首先,强调我国在该原则发展过程中起到的作用;其次,从我国展开国际合作、推动国内经济发展进程、资金机制和技术开发移转机制四个方面分析我国所面对的挑战;最后,就上述挑战提出相应的解决办法。在当前形势下,探讨如何促进共同但有区别责任原则的积极发展,对于全球气候变化的遏制和改善将有着十分重要的意义。
