我国公务员绩效考核法治化研究

【摘要】:党的十八大以来,全面推进依法治国,社会主义法治的理念深入人心,各级政府对依法治国、依法行政高度重视。作为依法行政的重要环节,公务员的绩效考核的重要性可见一斑。为此,迫切需要开展公务员绩效考核活动,从而完善我国的公务员绩效考核法治化制度,全面推进政务公开、依法行政。但是,目前我国公务员绩效考核法治化还没有一套完整的指标体系,同时在科学化、法治化、系统化层面又不够全面。公务员绩效考核是依法行政、建设法治政府的重要不可或缺的一部分。目前,我国公务员绩效考核法治化的办法都已经或正在被制定,但是这些办法、措施要达到公务员绩效考核法治化的水平还为时尚早。表现为考核办法单一、指标不科学、考核综合体系尚未建立。借鉴世界各国具体的做法和已经取得的成果,再对照我国公务员绩效考核法治化的现状,要实现我国公务员绩效考核的规范化、合理化发展就必须完善相关公务员绩效考核法律法规进而形成完善的公务员绩效考核法律制度,更好的实现政府切实履行职能、实现依法行政。文章从以下几个方面展开论述:第一部分主要讲述公务员绩效考核法治化的意义。上世纪70~80年代西方发达国家普遍实行行政改革运动,在此次改革中公务员公务员绩效考核是改革的重点,得到了政府和民众的重点关注。而我国从上世纪90年代才开始引入公务员绩效考核制度,该制度在我国的起步较晚,各方面都不太成熟。我国历史上没有公务员绩效考核这一传统,又由于历史原因、人为因素、法治尚未完善都对我国公务员绩效考核提出了挑战。在公务员绩效考核法治化中,首先要弄清楚绩效的定义,才能更进一步的采取考核措施,总体来看我国的公务员绩效的定义具有多样化,包含人们生产和行为导致的各种结果,在很大程度上更加倾向于行为结果。考核的意思比较通俗易懂,他表达的是估量、评价和考察的意思。绩效考核其实可以简单的看作运用各种方法和手段对公务员在工作中综合表现进行的客观评价。文章介绍了西方发达国家美国、英国、日本主要绩效考核法律制度,其中着重阐述了美国公务员绩效考核法律制度和英国公务员绩效考核的指标体系。之后要重点分析了我国公务员绩效考核法治化建设的意义:有助于统一我国公务员绩效考核方式、有助于确定绩效考核权、有助于绩效考核活动开展和落实结果。完善的公务员管理系统需要一个高度法治化的公务员绩效考核体系,政府部门具有自己本身的公共属性,因此,公务员绩效考核不同于企业的绩效考核原则。第二部分主要讲述我国当前公务员绩效考核法治化建设所存在的主要问题。我国从上世纪90年代开始实行公务员绩效考核制度,从中央到地方都开始实行公务员绩效考核法治化制度,并颁布一些法规、政策等,取得了一定的成果,对改进公务员工作,提升政府行政效能具有重要意义。但是我们也应当看到我国推行绩效考核时间并不长,相关法律法规并不完善,很多地方公务员绩效考核存在的问题开始凸显。第三部分讲述推进公务员绩效考核法治化建设的具体对策。从完善公务员绩效考核法治化的内容、完善公务员绩效考核法治化的方式、科学设置公务员绩效考核的指标体系、完善公务员绩效考核法治化的救济制度四个层面展开,相信我国的公务员绩效考核法治化将会越走远。
[Abstract]:Of the party since eighteen, comprehensively promote the rule of law, people's governments at all levels of socialist rule of law concept, rule of law, administrative law attaches great importance. As an important part of the administration according to law, the performance appraisal of civil servants remarkable importance. Therefore, it is urgent to carry out the civil service performance appraisal activities, so as to improve the civil service performance appraisal law system in China and comprehensively promote open government, administration according to law. However, the civil service performance appraisal of China's rule of law is not a set of complete index system, at the same time, the rule of law in a scientific, systematic and comprehensive enough. The level of civil servant performance appraisal is an important part of the administration according to law, an integral part of the construction of the government by law. At present, civil servant the performance evaluation of China's rule of law means have been or are being developed, but these measures, measures to achieve the rule of performance appraisal of civil servants It is too early. The level of performance for the single index assessment method, is not scientific, comprehensive evaluation system has not been established. The model various countries specific practices and achievements, and then control the status quo of China's civil servants performance appraisal of the rule of law, in order to realize the performance appraisal of civil servants in China standardization, rationalization development must improve the relevant laws and regulations of civil servants performance appraisal and performance appraisal of civil servants formed the perfect legal system, realize the government to better perform its functions effectively, realize the administrative law. This article discusses the following aspects: the first part is mainly about the performance appraisal of civil servants under the rule of law. The western developed countries last century 70~80's widespread implementation of administrative reform in sports. The reform of civil servants performance appraisal is the key point of the reform, the focus of the government and people of China from the world. In 90s it began to introduce the civil service performance appraisal system, the system started late in China, all aspects are not mature. There is no performance appraisal of civil servants this tradition in the history of our country, but due to historical reasons, human factors, the rule of law has not been perfect for our country civil servants performance appraisal in civil servant performance challenges. The assessment of rule of law, first to clarify the definition of performance, in order to further take measures, China's overall performance has defined diversification, various results include production and people's behavior leads to a great extent, more inclined to behavior results. Assessment means more user-friendly, his expression is measure, evaluation and examination of the meaning of performance appraisal. It might be as simple as using various methods and means of objective evaluation of comprehensive performance of civil servants in the work of the article. The western developed countries, the United States, Britain, Japan's main performance appraisal legal system, which focuses on the performance appraisal of civil servants and the legal system of the British civil service performance evaluation index system. Then to focus on the analysis of the performance appraisal of Civil Servants Law in our country the construction of meaning: help to unify the evaluation performance of civil servant of our country, there are to help determine the performance appraisal rights, contribute to the performance appraisal activities and results. The implementation of civil service management system to improve the civil service performance appraisal system to a height of the rule of law, government departments have their own public property, therefore, the civil service performance appraisal is different from the enterprise performance appraisal principles. The second part is mainly about the main problems China's current performance appraisal of civil servants law construction exists. China began to implement the civil servants performance appraisal system from the last century in 90s Degree, from the central to local governments have started to implement the performance appraisal of civil servants law system, and promulgated some regulations, policies, and achieved certain results, to improve the work of civil servants, has important significance to enhance the administrative efficiency. But we should also see China's implementation of the performance appraisal is not a long time, relevant laws and regulations is not perfect. There are many places in the performance appraisal of civil servants began to highlight the problem. The third part is about the specific measures to promote the construction of rule of law, the civil service performance appraisal. From the consummation of the civil service performance appraisal of the rule of law, improve the civil service performance appraisal of the rule of law, set up a scientific civil servant performance appraisal index system, improve the performance appraisal of civil servants law relief four aspects system, believe that the civil service performance appraisal of rule of law in China will farther away.
