广西循环经济立法问题研究

【摘要】：随着人们对可持续理念认识的加深,现在人们越来越强调要改变经济发展模式。新的经济发展模式需求推动了循环经济的产生与发展,循环经济就是在新的形势下,通过积极探索得出的经济发展模式。我国初度对循环经济加以法律规定是在2009年的《中华人民共和国循环经济促进法》,至此我国循环经济在法律层面有了强有力的引导和支持。广西是中国西部人口众多、资源丰富的省份,但经济发展程度没有与优越的资源成正比,工、农、林等各产业尚有很大的发展空间,特别是循环经济的发展具有很大的潜力。但如果仅依靠国家层面的《循环经济促进法》在广西的实施是很难使循环经济发展模式在广西推广和发展的,我省迫切需要一部能够有明确、操作性强的地方性法律,比方说《广西壮族自治区循环经济促进条例》等类似的地方性法律。本文主要探讨和推敲广西循环经济在立法上涉及的一些问题,从近况到问题,从国外到国内,从优势到立法可行性,从宏观构想到微观构想等各方面做浅要剖释,为广西制定如循环经济条例等地方性立法和贯彻落实《循环经济促进法》做少许建议。本文围绕广西现行循环经济法律制度,着重讨论四个方面的问题:第一,对循环经济的定义及其特征进行简要分析,论述它与其他相关概念的区别,以更好地区分循环经济这一基本概念与其他相似性概念。第二,分析广西现行的循环经济法律制度及其存在的问题,即从国家层面和广西地方层面的现有相关法律进行分析与归纳。第三,对德、日等国外循环经济立法比较完善的国家进行对比和借鉴,汲取国内其他省份进行过的相关循环经济立法活动的实践经验。第四,广西循环经济立法的构想。先从广西发展循环经济的优势及其立法的必要性、可行性进行切入,进而从宏观和微观两方面进行立法构想。
[Abstract]:With the deepening of people's understanding of the concept of sustainability, people are now more and more emphasizing the need to change the pattern of economic development. The demand for a new model of economic development promotes the emergence and development of circular economy, which is under the new situation. In 2009, the circular economy promotion law of the people's Republic of China "," the circular economy of our country has a strong legal level. Guangxi is the western part of China with a large population, In resource-rich provinces, however, the degree of economic development is not directly proportional to superior resources. There is still much room for development in industries such as industry, agriculture, forestry, etc. In particular, the development of circular economy has great potential. However, it is difficult to popularize and develop the circular economy development model in Guangxi only by relying on the implementation of the "Circular economy Promotion Law" at the national level. Our province is in urgent need of a local law that is clear and operational. For example, the "regulations on the Promotion of Circular economy in the Guangxi Zhuang Autonomous region" and other similar local laws. This paper mainly discusses and examines some issues involved in the legislation of Guangxi's circular economy, from the recent situation to the problem, from abroad to home. From the advantages to the feasibility of legislation, from the macro concept to the micro concept and other aspects of shallow interpretation, Some suggestions are made for Guangxi to formulate local legislation such as circular economy regulations and to implement the Circular economy Promotion Law. This paper focuses on four aspects of the current circular economy legal system in Guangxi: first, This paper briefly analyzes the definition and characteristics of circular economy, and discusses the differences between it and other related concepts in order to better distinguish the basic concept of circular economy from other similar concepts. This paper analyzes the current legal system of circular economy in Guangxi and its existing problems, that is, from the national level and the local level of Guangxi, the existing relevant laws are analyzed and summarized. Japan and other countries with relatively perfect legislation on circular economy are compared and used for reference, drawing on the practical experience of relevant circular economy legislation activities carried out by other provinces in China. 4th, The conception of Guangxi circular economy legislation. First, from the advantages of Guangxi circular economy development and the necessity and feasibility of legislation, and then from the macro and micro aspects of legislative ideas.
