论网约车运营的监管法律制度的完善

【摘要】:传统巡游式出租车行业肩负着城市公共交通的重担,由于受到政府的数量管控,处于一种供不应求的状态,网约车的出现,在一定程度上缓解了这种供小于求的局面,就如同学者所认为的网络约车不仅实现了出行的高效和便捷,还发掘了群众未被满足的需求并缓解了公共出行供给不足的"痛点"。但是,由于网约车的迅猛发展,其自身的不足也不断凸显,对传统巡游式出租车行业的不利影响也随着矛盾的加深而加深,冲突也随之加剧。2015年,在我国多地爆发了巡游式出租车司机罢工抵制网约车的事件,巡游式出租车罢工,对一个城市造成的损失是巨大的。道路交通的瘫痪、群众出行的不便,这些都让人对网约车这一新业态进行思考,并提出了对网约车规制的法律制度,但是,从目前的规制制度上看,仍存在一些问题,例如在规制的主体、市场准入条件、运营监管、主体责任等方面。网约车作为一种伴随互联网技术发展而发展起来的新事物,我国规制网约车行为的法律法规还不是很完善,尚存在很多问题,但是从网约车和传统巡游式出租车行业的矛盾来看,现有的法律规制制度并不能很好的缓解或解决两者的矛盾,所以构建完善的监管法律制度是十分必要的,也是切实可行的。所以本文旨在通过讨论监管的实施主体、网约车的市场准入、运营监管以及主体责任等问题,提出如何构建完善网约车行为的监管法律制度体系,使监管部门能够更有效率地进行监管。
[Abstract]:The traditional tour taxi industry is shouldering the heavy burden of urban public transport. Because of the government's quantity control, it is in a state of short supply, and the appearance of the net ride-sharing alleviates to a certain extent the situation that the supply is less than the demand. As the scholars believe, the online car ride not only realizes the high efficiency and convenience of the trip, but also uncovers the unmet demand of the masses and alleviates the "pain point" of the insufficient supply of public travel. However, due to the rapid development of the online car, Its own shortcomings are also constantly highlighted, and the adverse impact on the traditional tour taxi industry has deepened with the deepening of the contradictions, and the conflict has also intensified. In 2015, there was an incident in our country in which the tour taxi drivers went on strike to boycott the ride-sharing network. The travelling taxi strike has caused a huge loss to a city. The paralysis of road traffic and the inconvenience caused by mass travel all make people think about the new form of car sharing on the net, and put forward a legal system for regulating the net car chartering. However, from the point of view of the current regulation system, there are still some problems, such as the subject of regulation, market access conditions, operation supervision, subject responsibility and so on. The laws and regulations to regulate the behavior of ride-hailing in our country are not perfect and there are still many problems. However, from the perspective of the contradiction between net-ride-hailing and traditional cruising taxi industry, The existing legal regulation system can not alleviate or solve the contradiction between the two, so it is very necessary and feasible to construct a perfect regulatory legal system. On the basis of the problems of market access, operation supervision and main body responsibility, the author puts forward how to construct and perfect the legal system of the regulation of ride-sharing behavior, so as to make the supervision department more efficient.
