我国融资担保公司监管法律制度研究

【摘要】：融资担保公司从出现到不断的发展,不仅有利于解决中小企业融资难的问题,而且极大的带动和促进了中小企业的发展,从而促进了市场经济的不断发展。我国融资性担保公司不断向着专业化、产业化、综合化的方向发展,但是为了追求利益,一些融资性担保公司进行违法活动来追逐高额利润获得盈利,严重破坏了行业的稳定发展。前我国融资担保公司监管法律制度仍然存在很多不足,使得我国融资担保市场出现混乱,最终使整个行业的发展都会受到极大的影响。本文首先对我国融资担保公司进行了较为全面的概述,并且通过对我国融资担保公司监管法律制度的现状的分析,重点突出了我国融资担保公司法律监管制度存在的立法层级较低、监管主体不明以及具体监管制度不健全等问题,并且充分借鉴美国和日本融资担保公司监管制度的优越性,提出统一制定融资担保公司监管法律准则、确立融资担保分业经营分业监管的模式、健全各项具体融资担保监管制度等完善我国融资担保公司监管法律制度的建议。
[Abstract]:Financing guarantee companies from the emergence to the continuous development, not only help to solve the financing difficulties of SMEs, but also greatly promote and promote the development of small and medium-sized enterprises. This has promoted the continuous development of the market economy. The financing guarantee companies in our country have been developing in the direction of specialization, industrialization and integration, but in order to pursue the benefits, Some financing guarantee companies engage in illegal activities to pursue high profits and gain profits, which seriously undermines the steady development of the industry. There are still many deficiencies in the former legal system of supervision of financing guarantee companies in China. It makes the financing guarantee market of our country appear chaos, and finally the development of the whole industry will be greatly affected. Firstly, this paper gives a more comprehensive overview of the financing guarantee companies in our country. And through the analysis of the current situation of the supervision legal system of the financing guarantee company in our country, the problems of the legal supervision system of the financing guarantee company in our country are emphasized, such as the low level of legislation, the unclear subject of the supervision and the unsound concrete supervision system, etc. And draw lessons from the advantages of the American and Japanese financing guarantee companies' supervision system, put forward the unified formulation of the financing guarantee company supervision legal standards, and establish a separate financing guarantee business supervision model. Perfect all kinds of concrete financing guarantee supervision system and so on consummate our country financing guarantee company supervision legal system suggestion.
