【摘要】：随着社会的发展我国人口增长率逐年下降,家庭结构从传统的家庭模式向三口之家小家庭模式发展,随之而来的养老入托问题成为社会热点。旧的养老和抚养观念还未转变和面临的与之相配套的制度的不健全。于是便出现了黑心养老院,幼师虐童案,保姆虐婴案。面对不断出现的社会问题,《刑法修正案九》增加了虐待被监护人、看护人罪,扩大了虐待罪的主体范围意图使更多受害者的合法权益得到保护。同时虐待型犯罪形成了以虐待罪,虐待被监护人、看护人罪,虐待被监管人罪,虐待部属罪,虐待俘虏罪为内容的类型犯罪。本文旨在围绕虐待型犯罪对各罪进行探讨,得出该类型犯罪的特点。本文主要分为六部分:第一章引言。旨在引出本文的研究目的及意义,研究现状和本文创新之处。第二章虐待犯罪的概述。阐述虐待犯罪的概念,整个类型犯罪中包含哪些罪名。我国古代虐待犯罪的立法沿革,新中国虐待犯罪的完善过程以及国外虐待犯罪立法的借鉴。第三章虐待犯罪客体之研究。论述虐待犯罪客体的概念,虐待犯罪客体与法益的关系,虐待犯罪中各罪的客体特点。第四章虐待犯罪客观行为之研究。探讨了虐待犯罪客观方面的共性和各罪客观方面的特点。第五章虐待犯罪之主体研究。本部分阐述了虐待犯罪的主体范围。第六章虐待犯罪之主观方面研究。虐待犯罪为故意犯罪,本部分就主观故意进行探讨,结合主观方面将虐待犯罪与相近似罪做区分。
[Abstract]:With the development of society, the population growth rate of our country drops year by year, the family structure develops from the traditional family model to the small family model of three people. The old concept of old-age and upbringing has not been changed and the corresponding system is not perfect. As a result, there is a dark-hearted nursing home, child abuse cases of kindergarten teachers, babysitters cases of child abuse. In the face of the emerging social problems, the Criminal Law Amendment 9 increases the crime of mistreatment of guardians and caregivers, and expands the scope of the subject of the crime of abuse with a view to protecting more victims' legitimate rights and interests. At the same time, the crime of mistreatment forms the crime of maltreatment, mistreatment of the guardian, the crime of carer, the crime of mistreatment of the supervised, the crime of abusing subordinates, and the crime of abusing prisoners. The purpose of this paper is to discuss each crime around the crime of maltreatment, and obtain the characteristics of this type of crime. This paper is divided into six parts: the first chapter is the introduction. The purpose of this paper is to lead to the purpose and significance of the research, research status and innovation of this paper. The second chapter is an overview of the crime of abuse. Explain the concept of the crime of abuse, the entire type of crime included in the charge. The legislative evolution of the crime of abuse in ancient China, the perfect process of the crime of abuse in New China and the reference of the legislation of the crime of abuse abroad. The third chapter is about the object of abuse. This paper discusses the concept of the object of the crime of abuse, the relationship between the object of the crime of abuse and the interests of law, and the characteristics of the object of each crime in the crime of abuse. The fourth chapter is about the objective behavior of abusing crime. This paper probes into the common character of the objective aspects of the crime of maltreatment and the characteristics of the objective aspects of each crime. The fifth chapter studies the subject of the crime of abuse. This part describes the scope of the main body of the crime of abuse. Chapter VI the subjective aspects of the crime of abuse. The crime of maltreatment is an intentional crime. This part discusses the subjective intention and distinguishes the crime of abuse from the similar crime.
