【摘要】：在国家城市化、工业化的推动下,大量新生代农民工向城市进行转移,人口的迁移造成农村土地的荒置化现象的出现,为了实现土地资源的高效利用,新生代农民工承包地该何去何从?围绕新生代农民工土地权利退出主题,论文扩展了研究的问题链。具体包括:新生代农民工承包地该不该退出、能不能退出、愿不愿退出?哪些因素影响他们退出承包地?退出需要什么样的条件?退出动力机制如何、需要增强哪些动力?该如何建立退出补偿机制?退出存在哪些风险、该如何防范?需要建立怎样的承包地退地行为有效激励和约束机制?围绕问题链条,论文展开了体系的分析。这包括:首先,新生代农民工土地权利退出的可行性分析。研究认为,新生代农民工由于市民化意识的增强、思想观念。收入结构等的变化以及生活方式等趋同于城市中的同辈人,为实现其土地权利的有序退出创造了条件。其次,新生代农民工土地权利退出的必要性分析。研究认为,在提高土地利用率,实现土地现代化经营的要求下、新生代农民工“脱民化”的发展现状及村落社区运行主体的缺位的现状下,有必要实现新生代农民工土地权利的退出。再次,新生代农民工土地权利退出的困难分析。研究认为,社会保障制度的不完善、土地退出的激励机制缺失、退出程序的不规范、土地价格评估机制的不完善等都在一定程度上阻碍着新生代农民工土地权利的退出。最后,新生代农民工土地权利退出的路径分析。研究认为,对于新生代农民工的土地权利的退出应从建立健全土地退出机制、完善城乡之间的承接机制、完善社保制度、健全农地价格评估机制等方面入手,推动新生代农民工的土地权利的退出。对进行新生代农民工土地权利退出的背景和进行研究的意义进行分析,对国家的土地经营的现状及新生代农民工的现状进行一定的描述分析;对新生代农民工土地权利退出的原因进行分析,明确新生代农民工土地权利退出的原因,更好地推动其身份的转变;对新生代农民工土地权利退出的可行性分析,在现有的条件下分析新生代农民工退出中的有利条件,以对此进行强化;对新生代农民工土地权利退出的困难进行分析,找出在其土地权利退出过程中存在的困难,为解决此类困难,实现土地权利退出提供可能性;对新生代农民工土地权利退出的路径进行研究,探寻一条适合新生代农民工土地权利退出的路径,推动其更好地实现土地权利的退出,提高土地资源的利用率。
[Abstract]:Driven by the urbanization and industrialization of the country, a large number of new generation of migrant workers have been transferred to cities, and the migration of population has resulted in the phenomenon of rural land desolation, in order to realize the efficient use of land resources. The changes of income structure and lifestyle, which converge to the peers in the city, create conditions for the orderly withdrawal of their land rights.
