【摘要】：依法治国的提出是响应世界政治经济发展的需求,也是顺应时代发展的必然选择。依法治国是社会进步和发展的标志,也是我们党领导全国人民参与国家事务管理的理想方略。我国社会主义法治建设经历了党几代领导人的艰辛探索和科学总结,形成系统科学的中国特色社会主义法治理论。毛泽东在领导中国革命和建设的伟大实践中,以马克思主义基本原理为指导,根据中国实际国情进行科学的分析考察和总结,提出了一系列关于中国社会主义革命和建设的战略思想,并制定出一系列关于中国社会主义革命和建设的方针政策。邓小平总结文革时的错误思想,主张建设社会主义法制,认为法规制度是带有全局性、根本性的大问题,强调指出要用“法制”代替“人治”思想。以江泽民为核心的党的第三代中央领导集体,在党的十五大上明确地提出了“依法治国,建设社会主义法治国家”的基本方略,指出了依法治国思想的实施方略,并把“依法治国”方略载入宪法。以胡锦涛为总书记的党中央领导集体在新世纪新阶段将依法治国继续推进,在对依法治国方略进行深化的基础上提出了社会主义法治理念。提出以实施宪法为重点、以树立法治理念为支点,丰富依法治国的理论体系,推动了依法治国的实践进程。以习近平为总书记的新的中央领导集体深刻阐述依法治国的重要性,坚持党的领导、人民当家作主和依法治国的有机统一,坚定不移地走中国特色社会主义道路。在全面建成小康社会、全面深化改革、全面从严治党的基础上,全面推进依法治国。在经济全球化的总趋势下,依法治国方略的提出符合社会主义市场经济的发展需求。回顾改革开放以来党领导人民依法治国的历程,深刻总结法治教训与经验。在新时期坚持马克思主义的指导,坚持党的领导、人民当家做主和依法治国有机统一,坚持依法治国与以德治国相结合,立足国情、解放思想、实事求是,与时俱进、开拓创新,对我国实现全面推进依法治国的总目标形成有益启示。启发我们党主要从全面进行普法教育,弘扬法治精神、加强立法工作,健全中国特色杜会主义法律体系、完善和强化监督机制、推进司法改革,建立我国司法独立体制、建立科学有效的反腐机制等实处着手,全面推进我国的法治建设。
[Abstract]:The proposal of governing the country according to law is an inevitable choice to respond to the demands of the world's political and economic development and to conform to the development of the times. Ruling the country according to law is a sign of social progress and development, and an ideal strategy for our party to lead the whole nation to participate in the management of state affairs. The construction of socialist rule of law in our country has experienced the painstaking exploration and scientific summarization of several generations of leaders of the Party and formed a systematic and scientific theory of socialist rule of law with Chinese characteristics. In the great practice of leading the revolution and construction of China, Mao Zedong, guided by the basic principles of Marxism, conducted a scientific analysis and summary according to the actual conditions of China. This paper puts forward a series of strategic thoughts about Chinese socialist revolution and construction, and formulates a series of principles and policies on Chinese socialist revolution and construction. Deng Xiaoping summed up the erroneous ideas of the Cultural Revolution, advocated the construction of the socialist legal system, held that the legal system was a major problem with overall and fundamental significance, and emphasized that the idea of "rule of man" should be replaced by "legal system". At the 15th National Congress of the Party, the third generation of the central leading collective with Jiang Zemin as the core put forward the basic strategy of "governing the country according to law and building a socialist country ruled by law", and pointed out the general plan of implementing the thought of governing the country according to law. And the "rule of law" strategy enshrined in the Constitution. The collective leadership of the CPC Central Committee with Hu Jintao as its general secretary will continue to push forward the rule of law in the new century and put forward the concept of socialist rule of law on the basis of deepening the strategy of governing the country according to law. This paper puts forward the idea of establishing the rule of law as the fulcrum, which enriches the theoretical system of governing the country according to law and promotes the practice of governing the country according to law. The new central leadership collective with Xi Jinping as the general secretary profoundly expounds the importance of governing the country according to law, adheres to the leadership of the Party, the organic unity of the people as the master of the country and the rule of law, and unswervingly follows the socialist road with Chinese characteristics. On the basis of building a well-off society in an all-round way, deepening reform in an all-round way and administering the party strictly, we should comprehensively promote the rule of law. Under the general trend of economic globalization, the strategy of governing the country according to law is in line with the development needs of socialist market economy. Reviewing the course of the Party leading the people to rule the country according to law since the reform and opening up, and summarizing the lessons and experiences of the rule of law. In the new period, we should adhere to the guidance of Marxism, the leadership of the Party, the organic unity of the people as masters and the rule of law, the combination of the rule of law with the rule of virtue, the emancipation of the mind, seeking truth from facts, and keeping pace with the times, based on the national conditions. Opening up and innovating will bring beneficial enlightenment to the realization of the overall goal of governing the country according to law in an all-round way. To inspire our Party to carry out comprehensive legal education, to carry forward the spirit of rule of law, to strengthen legislative work, to improve the legal system of socialism with Chinese characteristics, to perfect and strengthen the supervisory mechanism, to promote judicial reform, and to establish an independent judicial system in our country. The establishment of scientific and effective anti-corruption mechanism and other practical work to promote the rule of law in our country.
