权责关系视角下政府权力清单制度研究

【摘要】：在国家实行深化改革这一社会环境下,施行权力清单这一制度成为规范政府权力运行、推进政府管理体制改革、建立有限政府、法治政府的重要举措,它的改革与完善与国家全方位改革的顺利进行、市场和社会的和谐稳定以及民众之根本利益的实现密切相关。十八大至今,通过党中央、国务院的战略部署,各级政府纷纷加快了政府权力清单制度的推行力度,不仅权力清单公开的数量甚至公开的水平,都出现了前所未有的姿态,政府权力的公开透明、民众对行政权力的监督、提高政府绩效等方面初见成果。但是,政府权力清单制度作为一项新事物,它的制定与实施不可避免的会出现一定的问题,也面临着重重困难,这些困难与问题在一定程度上与没有明晰权责关系有关,而权责关系作为政府行政管理理论与实践的重要内容,权责统一作为一种行政观念与理想状态,它对政府的权力与责任行为具有重要的导向和制约作用,对政府权力清单制度的完善也产生了重要影响,因而,以权责关系为视角来研究这一制度有助于我们有针对性地认识和把握其制度的一般性与特殊性,对其探究具有积极的理论价值与实践意义。本文将从当前我国推行这一制度的具体实践出发,基于系统分析权责关系以及其概念与理论,以浙江、湖北、安徽、上海作为清单模板对当前我国政府权力清单制度推行的沿革与现状进行了阐述,并且以权责关系为视角,在权责界限、权责衔接、权责统一方面对当前我国政府权力清单制度存在的问题进行全面而深入分析,在此基础之上,针对我国实施这一制度中存在的问题,以明确权责关系为切入点,为改革与完善这一制度提出可操作性的对策建议,希望通过这些对策建议,能够积极推动政府权力清单制度的改革与完善,通过本文理论与实践的积极探讨可以服务于当前政府权力清单制度推行的实践,从而促进政府全方位履行其职能,推动经济与社会和谐进步,顺利实现全方位改革、全面建成小康社会的既定目标。
[Abstract]:Under the social environment of deepening the reform of the state, the implementation of the power list system has become an important measure to standardize the operation of government power, to promote the reform of the government management system, to establish a limited government and to rule by law. Its reform and perfection are closely related to the smooth progress of the all-round reform of the country, the harmony and stability of the market and society, and the realization of the fundamental interests of the people. Since the 18th CPC National Congress, through the strategic arrangements of the CPC Central Committee and the State Council, governments at all levels have accelerated the implementation of the power list system one after another. Not only has the number or even the level of openness of the list of powers come to an unprecedented level, The transparency of government power, the supervision of administrative power and the improvement of government performance. However, as a new thing, the establishment and implementation of the government power list system will inevitably lead to certain problems and difficulties. These difficulties and problems are related to the lack of a clear relationship between power and responsibility to a certain extent. As an important content of the theory and practice of government administration, the unity of power and responsibility, as an administrative concept and ideal state, plays an important role in guiding and restricting the government's power and responsibility. Therefore, it is helpful for us to understand and grasp the generality and particularity of the system from the perspective of the relationship between power and responsibility. The exploration has positive theoretical value and practical significance. This article will proceed from the concrete practice of carrying out this system in our country at present, based on the systematic analysis of the relationship between power and responsibility and its concept and theory, to Zhejiang, Hubei, Anhui, Shanghai, as the template of the list, expounds the evolution and present situation of the implementation of the power list system in our country, and from the perspective of the relationship of power and responsibility, it links up the power and responsibility in the line of authority and responsibility. On the aspect of the unity of power and responsibility, this paper makes a comprehensive and in-depth analysis of the problems existing in the current government power list system in our country, on the basis of which, aiming at the problems existing in the implementation of this system in our country, we should make clear the relationship between power and responsibility as the starting point. In order to reform and perfect this system, it is hoped that the reform and perfection of the government power list system can be actively promoted through these countermeasures and suggestions. Through the active discussion of the theory and practice in this paper, it can serve the practice of the current government power list system, thus promote the government to perform its functions in all directions, promote the harmonious progress of economy and society, and smoothly realize the omni-directional reform. The established goal of building a well-off society in an all-round way.
