夫妻个人财产转化规则重拾与展开

【摘要】：在我国婚姻法中确定夫妻个人财产的一项重要制度是夫妻个人财产转化规则,它的发展可谓是命途多舛:其在经过十余年的“雪藏”之后,在新的社会环境下又激起学术界新一番激烈的讨论和研究。在立足研究国内外立法与实践经验的基础上,分析原支持废除转化规则的各种观点并进行博弈,通过前人的探究以及实践的检验充分说明转化规则在我国适用的合理性与可行性。但其也存在部分规定过于死板,不再适用于时代的发展和需要的缺点,因此本文着重从规则设计角度对转化规则制度进行完善与制度创新,以期用一种新的模式——逐年转化模式,即通过将夫妻个人财产在婚姻存续期间在夫妻间按比例的进行逐年转化,来解决夫妻个人财产在婚姻存续期间无法确定归属的问题。并且,在进行制度设计的基础上,再对规则转化适用的合理性进行检验,对夫妻生活中各类特殊财产划分归属难的问题进行说明。以期通过本文的研究与撰写,能够对我国夫妻个人财产制度的研究起到抛砖引玉的作用,从而可以推动对策规则更为深层次的思考和研究,为其“复出”增添有力的一笔。
[Abstract]:One of the important systems to determine the personal property of husband and wife in the Marriage Law of China is the transformation rule of personal property of husband and wife. Its development can be said to be ill-fated: after more than ten years of "snow hiding", In the new social environment, it arouses a new heated discussion and research in academic circles. Based on the study of domestic and foreign legislation and practical experience, this paper analyzes the various viewpoints that support the abolition of the transformation rules and carries on the game. The rationality and feasibility of the application of the transformation rules in our country are fully explained through the research of predecessors and the test of practice. However, some of its provisions are too rigid and no longer suitable for the development and need of the times. Therefore, this paper focuses on perfecting and innovating the system of transforming rules from the angle of rule design. In order to solve the problem that the couple's personal property can not be determined during the marriage, the author hopes to use a new mode-the annual transformation model, that is, the personal property of husband and wife is transformed in proportion between husband and wife in the period of marriage. Furthermore, on the basis of system design, this paper tests the rationality of the application of the rules, and explains the difficult problem of the division and attribution of various special property in the life of husband and wife. Through the research and writing of this paper, it can be helpful to the study of husband and wife's personal property system in our country, thus it can promote the further thinking and research of the countermeasure rules, and add a powerful stroke for its "return".
