网络环境下音乐作品著作权许可制度研究

【摘要】：音乐作品著作权许可制度是音乐作品著作权人行使音乐作品著作权行为的保障,其为音乐作品著作权人实现其音乐作品著作财产权利获得报酬提供了渠道,同时满足了音乐作品使用人对音乐作品的使用,对平衡音乐作品著作权人使用人利益、促进音乐作品传播起着十分重要的作用。而随着互联网技术的发展以及网络的普及,虽然方便了音乐作品使用人使用、扩大了音乐作品传播范围及影响范围,但是对传统音乐作品著作权许可制度带来了一定的冲击,给音乐作品著作权人合法利益造成了一定的损害,本文针对网络环境下对音乐作品著作权许可制度的影响,分析我国音乐作品著作权许可制度中存在的不足之处,借鉴国外网络环境下音乐作品著作权许可制度的有益经验,对《著作权法修改草案》的修订意见进行评析,并在此基础上提出完善我国音乐作品著作权许可制度的建议,更好的面对网络环境下对音乐作品著作权许可制度的冲击,保护音乐作品著作权的合法利益。
[Abstract]:The copyright licensing system of music works is the guarantee for the copyright holders of music works to exercise the copyright of music works, which provides a channel for the copyright owners of music works to realize the property rights of their music works and obtain remuneration. At the same time, it satisfies the use of music works by users, and plays an important role in balancing the interests of users of music works and promoting the dissemination of music works. With the development of the Internet technology and the popularization of the network, although it facilitates the users of music works and expands the scope of dissemination and influence of music works, it has a certain impact on the copyright licensing system of traditional music works. This paper aims at the influence of the network environment on the copyright licensing system of music works, and analyzes the shortcomings of the copyright licensing system of music works in our country. Based on the beneficial experience of the copyright licensing system of music works in foreign countries, this paper comments on the revision opinions of the revised draft of copyright Law, and puts forward some suggestions to perfect the copyright licensing system of music works in China. Better to face the impact on the copyright licensing system of music works under the network environment, to protect the legitimate interests of music copyright.
