离婚案件中异质人工授精引发的相关法律问题的研究

【摘要】：近年来,随着科技的发展,使用异质人工授精技术进行生育的人数不断增多,因之而产生的法律纠纷亦随之增加。然而,国内对于异质人工授精的相关研究较少,而且这些研究中也多属于自然科学与医学领域的研究,至于从法律角度进行的研究,就更为有限了。因此,本文试图从法律的角度出发,结合具体的案例,对异质人工授精引发的离婚案件进行相关的研究。本文引用了一则由异质人工授精引发的离婚案件,并总结了与此案判决息息相关的三个争议焦点。本文意图通过对这三个争议焦点的分析,来掌握与相关案件紧密相连的三个认定标准问题。本文认为,这则案例的研究价值在于,此案是当今社会中由异质人工授精技术引发的一类法律问题的一个缩影,通过对此案例的分析,可以从中学习并掌握对异质人工授精引发的相关标准的认定方法。本文的写作思路是,本文采用总-分-总的写作结构,共分四章与一个总结。第一章介绍了本文所引用的案件的经过与判决,并归纳了其中三个主要的争议焦点。第二章先介绍了我国法院有关感情破裂的认定标准,之后结合这些标准对案例进行了分析。第三章则是介绍了我国法律有关精神损害赔偿的规定,在此基础之上,本文结合案例针对异质人工授精引起的精神损害赔偿进行了法律适用上的分析。第三章对案中男孩与原告的亲子身份认定进行了分析,并同时分析了另两种与本案相似的情况,由分析中可知,在婚姻关系存续期间出生的异质人工授精子女亲子身份的认定需要根据不同情况区别对待。在最后的总结中,本文对全文进行了全面而简短的阐述。
[Abstract]:In recent years, with the development of science and technology, the number of fertility using heterogeneous artificial insemination technology is increasing, and the resulting legal disputes are also increasing. However, there are few researches on heterogeneous artificial insemination in China, and most of these studies belong to the field of natural science and medicine, and the research from the angle of law is even more limited. Therefore, this paper tries to study the divorce cases caused by heterogeneous artificial insemination from the point of view of law, combined with specific cases. In this paper, a divorce case caused by heterogeneous artificial insemination is cited, and three controversial issues are summarized. Through the analysis of these three focal points of dispute, this paper tries to grasp the three standard issues which are closely related to the relevant cases. This paper holds that the research value of this case is that it is a microcosm of a class of legal problems caused by heterogeneous artificial insemination in today's society. We can learn and master the methods of identifying the standards caused by heterogeneous artificial insemination. The idea of this thesis is to adopt the structure of total-division-total writing, which is divided into four chapters and a summary. The first chapter introduces the process and judgment of the cases cited in this paper, and summarizes the three main controversial points. In the second chapter, the author first introduces the recognition standards of emotional rupture in Chinese courts, and then analyzes the case with these standards. The third chapter is to introduce the provisions of Chinese law on compensation for mental damage, on the basis of this, this article combined with the case of heterogeneous artificial insemination caused by mental damage compensation for the analysis of the application of the law. The third chapter analyzes the paternity and child identification of the boy and the plaintiff, and at the same time analyzes the other two situations similar to this case, which can be seen from the analysis. The identification of parent-child status of heterogeneous artificial insemination children born during marriage needs to be treated differently according to different circumstances. In the final summary, this paper gives a comprehensive and brief account of the full text.
