互联网医疗监管法律问题研究

【摘要】：互联网与医疗行业的融合,形成了互联网医疗这个新型医疗模式。不同于传统医疗,互联网医疗具有医患双方的非接触性、患者自主性增强以及需要借助网络技术服务等特点。互联网医疗为我们生活提供了极大的便利,但是,这种医疗模式也引发了新的法律问题。本文从互联网医疗的市场准入、互联网医疗服务、互联网医疗事故处理三个方面对互联网医疗监管中的法律问题进行分析,各章主要内容如下:第一章对互联网医疗进行了界定和分类,根据提供服务内容不同,分为医疗保健知识分享平台、实体医疗机构的互联网辅助应用、互联网医疗平台。从市场准入、医疗服务和医疗事故处理三方面提出互联网医疗监管中的法律问题,并分析了我国目前互联网医疗监管的立法现状。第二章针对互联网医疗平台和非医疗平台,分析各自的准入条件和准入程序。互联网医疗平台的主体应当是具有二级甲等资质实体医疗机构,提供服务的医生应当有医师资格证书、执业证书及相应的职称证书。互联网非医疗平台应当有具备相应资质的两名以上的正式全职员工。医院等实体医疗机构的互联网辅助应用,具备相应的从业人员、互联网技术与设备等条件,符合并履行相关的法律程序,即可提供该项服务。第三章根据互联网医疗服务流程,分析了分诊导诊、信息安全保障、网上医疗服务行为三方面监管的现状以及其中的法律问题,并提出相应的法律建议,如针对不同分类的疾病在网上分类处理,对电子病历采用统一标准并延长保存时间等。第四章结合当前互联网医疗事故处理的相关法律法规以及实际中的处理情况,分析存在的问题,提出相应的监管建议。提出在处理互联网医疗技术事故时应当考虑患者自主性以、信息技术局限免责及网络技术设备在诊疗活动中作用等影响因素。
[Abstract]:The amalgamation of Internet and medical industry has formed the new medical model of internet medical treatment. Different from traditional medical treatment, Internet medical treatment has the characteristics of non-contact between doctors and patients, enhanced patient autonomy and the need of network technical services. Internet medical treatment provides us with great convenience in life, but this mode of medical care also raises new legal problems. This paper analyzes the legal problems in Internet medical supervision from three aspects: market access for Internet medical treatment, Internet medical service and handling of Internet medical malpractice. The main contents of each chapter are as follows: the first chapter defines and classifies the Internet medical care, according to the different service content, it is divided into the medical care knowledge sharing platform, the Internet auxiliary application of the physical medical institution, the Internet medical platform. This paper puts forward the legal problems in Internet medical supervision from three aspects of market access, medical service and medical malpractice treatment, and analyzes the current legislative situation of Internet medical supervision in China. The second chapter analyzes the access conditions and procedures of internet medical platform and non-medical platform. The main body of the internet medical platform should be the medical institution with the second class A qualification entity, the doctor who provides the service should have the doctor qualification certificate, the practice certificate and the corresponding professional title certificate. The internet non-medical platform should have more than two full-time employees with corresponding qualifications. The Internet auxiliary application of hospitals and other entity medical institutions has the corresponding conditions such as employees, Internet technology and equipment, and conforms to and performs the relevant legal procedures, which can provide this service. The third chapter, according to the flow of Internet medical service, analyzes the current situation and the legal problems of the three aspects of the supervision, such as diagnosis and consultation, information security and online medical service behavior, and puts forward the corresponding legal suggestions. Such as different classification of diseases in the online classification, electronic medical records to adopt a unified standard and extend the preservation time and so on. The fourth chapter analyzes the existing problems and puts forward the corresponding supervision suggestions based on the related laws and regulations of Internet medical malpractice treatment and the actual situation. It is suggested that the influence factors such as patient autonomy, information technology limitation exemption and the role of network technology equipment in diagnosis and treatment activities should be taken into account when dealing with Internet medical technical accidents.
