云霄县海洋渔业保护的行政执法研究

【摘要】：对于海洋渔业的保护工作要从源头抓起,对于那些放进海洋的有害物质进行控制,这些源头工作就要从最基本以及最基层的执法工作抓起来,要求工作在基层的执法人员负起责任,做好监督工作,从最基础的工作来保护海洋渔业,让海洋渔业也走上可持续发展的道路。本文以云霄县为研究对象,采用案例分析法、文献分析法、比较分析法等研究方法对云霄县海洋渔业保护的行政执法进行深入研究。首先分析云霄县海洋渔业保护基层行政执法现状,进而指出云霄县海洋渔业保护基层行政执法所存在的问题,主要包括:海洋渔业保护执法主体分散、海洋渔业保护执法行为不规范、执法力量薄弱、海洋渔业保护行政执法督察不到位。其次剖析云霄县海洋渔业保护行政执法存在问题的原因,主要包括:渔业行政执法机构配置不合理、综合执法机制整合改革尚未到位、行政执法人员素质有待提高、海洋渔业保护执法监督机制不完善。在此基础上,借鉴国内外海洋渔业保护行政执法经验。最后提出云霄县海洋渔业保护行政执法的优化建议,主要包括:深化渔业行政管理体制改革、规范执法行为提高执法能力、加强海洋渔业保护行政执法人员的培训、完善督察制度。
[Abstract]:For the protection of marine fisheries, we should start from the source and control those harmful substances that are put into the ocean. These sources should be taken up from the most basic and grass-roots law enforcement work. Law enforcement personnel working at the grass-roots level are required to take responsibility, do a good job of supervision, from the most basic work to protect the marine fisheries, so that marine fisheries are also on the path of sustainable development. This paper takes Yunxiao County as the research object, uses the case analysis method, the literature analysis method, the comparative analysis method and so on the research method carries on the thorough research to the Yunxiao county marine fishery protection administrative law enforcement. Firstly, it analyzes the current situation of the basic administrative law enforcement of marine fishery protection in Yunxiao County, and then points out the problems existing in the basic administrative law enforcement of the marine fishery protection in Yunxiao County, mainly including: the main body of marine fishery protection law enforcement is dispersed. The enforcement action of marine fishery protection is not standard, the enforcement force is weak, and the supervision of marine fishery protection administration law enforcement is not in place. Secondly, it analyzes the reasons for the problems in the administrative enforcement of marine fishery protection in Yunxiao County, including the unreasonable allocation of fishery administrative law enforcement agencies, the uncompleted reform of the comprehensive law enforcement mechanism, and the improvement of the quality of the administrative law enforcement personnel. The law enforcement and supervision mechanism of marine fishery protection is not perfect. On this basis, draw lessons from the domestic and foreign marine fishery protection administrative law enforcement experience. Finally, the paper puts forward some suggestions to optimize the administrative law enforcement of marine fishery protection in Yunxiao County, including: deepening the reform of fishery administration system, standardizing the law enforcement behavior, enhancing the law enforcement ability, and strengthening the training of marine fishery protection administrative law enforcement personnel. We will improve the supervision system.
