马克思主义法学思想中国化的历史进程研究

【摘要】：马克思主义法学思想中国化与马克思主义中国化的历史进程一样是循序渐进、相伴相生的。以老一辈无产阶级革命领袖为代表的中国共产党人,以马克思主义法学思想为理论根源、以中国传统文化中的先进法学思想为理论渊源,把马克思主义法学思想的基本原理融入到社会主义革命和建设中,从而产生了博大精深的毛泽东的法学理论思想、邓小平的法制理论思想、江泽民的依法治国根本方略、胡锦涛的社会主义法治理念、习近平的法治理论体系,逐步实现马克思主义法学思想中国化,使马克思主义法学思想得以丰富。尤其是中国特色社会主义法律体系的发展和完善,成为马克思主义法学思想中国化的里程碑。本文以马克思主义法学思想中国化的逐步实现为线索和依据,以不同阶段作为分界点来挖掘马克思主义法学思想中国化的历史内涵。马克思主义法学思想中国化的历史进程分为三个阶段,其中初期阶段的代表人物是李大钊、陈独秀、李达,他们的主要贡献在于在中国开始大力宣扬马克思主义法学思想,将其核心主张引入中国;马克思主义法学思想中国化的发展阶段的代表人物是毛泽东、董必武、陈云,他们将马克思主义法学思想的精髓结合中国的历史情境进行阐述,这就成为中国特色社会主义法律体系的根源和基础,以邓小平、江泽民、胡锦涛和习近平为代表的几代国家领导人对其继承和延续,使马克思主义法学思想中国化进一步得以深化。通过对马克思主义法学思想中国化的历史进程的研究,我们得到了如下启示:保有并突出民族特性,是我们学习、引入、借鉴外来先进思想或者制度时,需要特别注意的;辩证看待西方法学思想,去伪存真,“取其精华,去其糟粕”;加强法学理论在大众中的传播力度,具体可以将法学理论传播与普法宣传相结合,拓展法学理论传播渠道,不断提升国家公务人员的法律素养。
[Abstract]:The Sinicization of Marxist legal thought and the historical process of Sinicization of Marxism are gradual and concomitant. The Communist Party of China, represented by the leaders of the proletarian revolution of the older generation, takes the Marxist legal thought as the theoretical source and the advanced legal thought in the Chinese traditional culture as the theoretical origin. By incorporating the basic principles of Marxist legal thought into the socialist revolution and construction, the extensive and profound legal theory of Mao Zedong, the legal theory of Deng Xiaoping, the fundamental strategy of running the country according to law of Jiang Zemin, Hu Jintao's idea of socialist rule of law and Xi Jinping's system of ruling by law gradually realize the Sinicization of Marxist legal thought, which enriches Marxist legal thought. In particular, the development and perfection of the socialist legal system with Chinese characteristics has become a milestone in the Sinicization of Marxist legal thought. This paper takes the gradual realization of Marxist legal thought as the clue and basis and uses different stages as the dividing point to excavate the historical connotation of Sinicization of Marxist legal thought. The historical process of the Sinicization of Marxist legal thought can be divided into three stages, among which the representatives of the initial stage are Li Dazhao, Chen Duxiu and Li Da. Their main contribution lies in the vigorous promotion of Marxist legal thought in China. The representative figures in the development stage of the Sinicization of Marxist legal thought are Mao Zedong, Dong Biwu, Chen Yun, who combine the essence of Marxist legal thought with the historical situation of China. This has become the root cause and foundation of the socialist legal system with Chinese characteristics, inherited and continued by several generations of state leaders, represented by Deng Xiaoping, Jiang Zemin, Hu Jintao and Xi Jinping. To further deepen the Sinicization of Marxist legal thought. Through the study of the historical process of the Sinicization of Marxist legal thought, we have obtained the following enlightenment: keeping and highlighting the national characteristics is what we need to pay special attention to when we learn, introduce and draw lessons from foreign advanced ideas or systems; We can dialectically treat the western legal thought, distinguish the false things, preserve the real things, "take the essence of it and get rid of the dross," and strengthen the dissemination of the legal theory among the masses. In particular, we can combine the dissemination of the legal theory with the popularization of the law, and expand the channels for the dissemination of the legal theory. Constantly improve the legal literacy of public servants.
