中国高校法治教育问题研究

【摘要】:当前,我国正在实施依法治国方略,着力建设社会主义法治国家,这是我们国家治理方式的重大变革,也是逐步推进国家治理体系和治理能力现代化的必要举措。建设法治国家,如果说制度是促进法治国家建设的前提,完备的法律体系是法治国家建设的基础,公正的司法是建设法治国家的保障,那么社会主义法治国家建设的关键应该是具备较高法律素质的公民。公民法治观念的树立、法律素质的提高,直接关乎法治国家建设的进程,但目前我们国家公民的法律整体素质,距离法治国家的要求还相差较远。要想达到会主义法治国家建设的要求,必须树立公民的法治观念。而法治观念不是生来就具有的,提高公民的法律素质、培育法治品质,必须依靠教育这一基本手段来实现。在法治教育的所有类别中,高校法治教育以其教育对象的特殊性,在推动中国法治进程中发挥着至关重要的作用。高校法治教育的对象为大学生,而大学生作为国家和社会发展的后备人才,必然会在未来社会各行各业中承担重要的角色和任务。因此研究高校法治教育,探讨如何提高大学生法律素质的问题成为中国法治建设进程中的重要课题。2016年,全民普法教育进入第七个五年规划,《依法治教实施纲要(2016-2020)》和《青少年法治教育大纲》相继发布。在中国特色社会主义法律体系已经建成、中国法治建设不断推进、国家不断重视法治教育的形势下,高校法治教育应结合中国法治建设的实践和自身承担的人才培养任务,积极响应国家将法治教育纳入国民教育体系的要求,系统梳理高校法治教育的相关理论、明确高校法治教育的教育目标,在明晰高校法治教育发展脉络的基础上,结合当前大学生的特点和高校实际,找准高校法治教育发展中存在的问题,从多方面着手提高高校法治教育效果。本文研究的内容包括以下六个部分:第1章,绪论。主要包括研究背景与意义、国内外研究现状综述、研究思路与方法、创新点与不足之处等内容。第2章,高校法治教育的一般理论概述。这一部分首先阐释了法治、法治教育、高校法治教育的内涵;系统分析了高校法治教育的理论资源为马克思主义法治理论、社会主义法治思想、西方法治理论等,为论文后续研究提供理论支持。第3章,中国高校法治教育的历史回溯与实践理路。这一部分从历史的维度出发,结合中国开展普法教育的历程,将高校法治教育的发展历史划分为曲折发展时期、探索发展时期、初步发展时期和创新发展时期四个发展阶段来考察其发展轨迹,并结合每个发展时期的不同情况分析高校法治教育的发展动因,总结中国高校法治教育发展的实践理路,为优化高校法治教育效果提供经验借鉴。第4章,中国高校法治教育的成绩与问题。在回顾中国高校法治教育发展历程的基础上,结合问卷调查和实地访谈,总结了中国高校法治教育取得的成绩和存在的问题,并通过系统梳理和深入思考,总结出导致中国高校法治教育问题的原因,为探索优化中国高校法治教育效果的路径提供现实依据。第5章,国外法治教育的现状与经验。学习和借鉴是我国推进法治国家建设进程中必不可少的一个环节,也是开展高校法治教育应采用的基本方法。本章选取具有代表性的英国、美国、日本和新加坡为借鉴对象,通过深入分析这几个国家开展法治教育的经验,为我国开展高校法治教育提供有益启示。第6章,提高中国高校法治教育效果的路径选择。这一部分为全文的重点,主要针对中国高校法治教育存在的问题和成因,从加强高校法治教育主客体建设、优化高校法治教育内容、拓展高校法治教育渠道、发挥高校法治教育载体的联动作用、营造良好的法治教育环境等五个方面探索优化高校法治教育的路径,以达到通过高校法治教育提高大学生法律素质的目的。
[Abstract]:At present, our country is implementing the strategy of governing the country by law, focusing on building a socialist country under the rule of law, which is a major change in the way of our country's governance and a necessary measure to promote the modernization of the state governance system and the ability to govern. The foundation of the construction of the rule of law is the foundation of the construction of the country under the rule of law. The key to the construction of the socialist country under the rule of law should be the citizens with high legal quality. The establishment of the concept of the rule of law of the citizens and the improvement of the legal quality are directly related to the process of building the rule of law, but the legal holistic elements of the citizens of our country are at present. In order to meet the requirements of the country under the rule of law, the concept of the rule of law must be set up. But the concept of the rule of law is not born with it. To improve the legal quality of the citizens and to cultivate the quality of the rule of law, we must rely on this basic means of education. The rule of law education in Colleges and universities, with the particularity of its educational object, plays a vital role in promoting the process of rule of law in China. The object of the rule of law education in Colleges and universities is college students. As a reserve talent for the development of the state and society, College Students will inevitably bear important roles and tasks in all walks of life in the future. Therefore, the study of the rule of law in Colleges and universities will be carried out. Education, to discuss how to improve the legal quality of college students has become an important issue in the process of the construction of the rule of law in China.2016 years. The universal universal law education has entered the Seventh Five Year Plan. The outline of the implementation of the rule of law (2016-2020) and the outline for the rule of law of the youth have been published. The legal system of socialism with Chinese characteristics has been built, China has been built. With the continuous promotion of the rule of law and the constant attention of the state to the rule of law education, the rule of law education in Colleges and universities should be combined with the practice of the construction of the rule of law in China and the task of training its own talents, and actively respond to the state's requirements for bringing the rule of law education into the national education system, systematically combing the relevant theories of the law education in Colleges and universities, and clarifying the rule of law education in Colleges and universities. The aim of education is to clarify the existing problems in the development of the rule of law education in Colleges and universities on the basis of the development of the rule of law education in Colleges and universities, to find out the existing problems in the development of the rule of law education in Colleges and universities, and to improve the effect of the rule of law education in Colleges and universities from many aspects. The contents of this paper include the following six parts: the first chapter, the introduction. In the second chapter, the general theory of rule of law education in Colleges and universities is summarized. This part first explains the connotation of the rule of law, the rule of law education and the rule of law education in Colleges and universities; the theoretical resources of the rule of law education in Colleges and universities are the Marx doctrine theory of rule of law and the society. The theory of rule of law and the theory of the rule of law in the West provide theoretical support for the follow-up study of the paper. The third chapter, the historical backtracking and practice of the rule of law education in Chinese colleges and universities. This part, starting from the historical dimension, combines the history of China's universal education, and divides the history of the development of the rule of law education into a tortuous development period, and explores the development of the law. In the period, the period of initial development and the four stages of the period of innovation and development to investigate its development track, and analyze the development motivation of the rule of law education in Colleges and universities in each period of development, summarize the practical logic of the development of the rule of law education in Chinese colleges and universities, and provide experience for optimizing the effect of the rule of law education in Colleges and universities. The fourth chapter, the Chinese University Law On the basis of reviewing the course of the development of the rule of law education in Chinese colleges and universities, on the basis of the history of the development of the rule of law education in Chinese colleges and universities, the achievements and existing problems of the rule of law education in Chinese colleges and universities are summarized with the combination of questionnaires and field interviews, and the reasons for the problems that lead to the rule of law education in Chinese colleges and universities are summed up through systematic and deep thinking, in order to explore and optimize the problems. The path of the effect of the rule of law education in Colleges and universities provides a realistic basis. The fifth chapter, the status and experience of the rule of law education in foreign countries. Learning and learning from the rule of law is an essential link in the process of promoting the construction of the rule of law in China. It is also the basic method to carry out the rule of law education in Colleges and universities. Slope as a reference, through in-depth analysis of these countries to carry out the rule of law education experience, to provide beneficial enlightenment for the rule of law education in Colleges and universities in China. The sixth chapter, to improve the path choice of the effect of the rule of law education in Chinese colleges and universities. This part is the focus of the full text, mainly aiming at the problems and causes of the rule of law education in Chinese colleges and universities, from Strengthening Universities and colleges. The subject and object construction of the rule of law education, optimize the content of the rule of law education in Colleges and universities, expand the channels of the rule of law education in Colleges and universities, play the linkage role of the carrier of the rule of law education in Colleges and universities, create a good environment for the rule of law education, and so on to explore and optimize the path of the rule of law education in Colleges and universities, so as to achieve the purpose of improving the legal quality of college students through the rule of law education in Colleges and universities.
