翻译美学视角下的法律文本翻译研究

【摘要】：自法律翻译（尤其是法律文本翻译）成为翻译领域内的研究热点以来，众多相关成果纷纷问世，掀起了法律文本翻译研究的热潮。然而，这些研究大多是从纯粹的翻译理论或者语言学理论视角进行的。随着学科之间的不断融合，当今众多学术问题的研究不再仅仅局限于单学科的小天地，而是倾向于从多学科的角度来进行。因此，法律文本翻译的研究也应该从多学科、多层次的角度进行深化和拓展。作为翻译与美学结合的产物，翻译美学已被广泛应用于文学翻译等领域，并取得了很大的成就。然而，运用翻译美学探讨法律文本翻译研究的成果却凤毛麟角。法律文本中不乏美学元素，法律文本翻译也不排斥美学原则。有鉴于此，本文尝试从翻译美学的角度探讨法律文本的翻译，以期拓宽翻译美学的研究范围、深化法律翻译的研究深度。 本文以翻译美学为理论依据，，首先探讨五条美学原则——精确美、逻辑美、规范美、庄重美和模糊美原则——在法律文本翻译中的表现形式。在对法律文本中的美学元素进行探讨的基础上，从审美主体角度出发，进一步提出了在法律文本翻译中实现美的途径，其中重点探讨了实现美学再现的方法，如增译、省译等。
