庭审语言的语用分析

【摘要】：庭审语言是一种特殊语用环境下的会话形式,它在词汇、语法等方面都有其独特性。通过运用相关语言知识对相关庭审案例进行的分析,庭审语言自身所具有的语用价值已经显而易见。本文研究的目的,就在于通过对庭审语言的语用分析,揭示语言技巧和语言策略的重要性。本文在论述之初,简介了庭审语言在语用研究方面所取得的成就及其相关进展。这一部分侧重对国内外现有研究理论的归纳总结。通过对这部分的资料搜集,笔者力图对庭审话语的相关研究现状进行相对有效的整理,对其脉络有一个相对完善的梳理。在此基础上,笔者受到一定的启发,对继续展开相关研究有了极大的帮助。本文的论述除了借鉴前人在庭审语料方面对庭审话语的言语行为进行分析(主要指运用奥斯汀的言语行为理论对庭审话语进行综合分析,对庭审言语行为进行分类,并对法庭上最具话语权的法官的宣判语言进行具体分析)之外,更强调运用所学的语言学相关的理论知识(主要包括功能主义语言学、心理语言学、逻辑语言学、社会语言学等),在搜集相关真实的庭审话语案例的基础上,对庭审话语在会话推理和会话形式上进行庭审作用的分析,侧重于研究不同的会话形式所代表的话语技巧和相关的语言策略以及对庭审宣判结果的影响,并在此基础上探讨庭审话语权力、策略等所反映出的社会制度性问题以及人文关怀在庭审语言中的缺失,呼吁相关部门的关注和相关政策的改革。本文的研究特色,主要在于：一、注重庭审案例的真实性和与相关语言点的高度契合性。二、注重对庭审角色的兼顾,并对相关语言点的覆盖性进行较深入的挖掘。三、注重庭审语言的具体话语分析,而不仅仅停留在话语表达的形式方面。四、在对庭审语言的分析方面,注重各类参考文献的吸收归纳,吸取相关经验,并在此基础上得到相应启发,进行有效的思考,在研究深度和广度上都有所延伸。五、引发庭审角色的转换和话语策略的运用所反映出的对社会制度性问题的思考。
[Abstract]:Trial language is a kind of conversational form in a special pragmatic environment. It is unique in terms of vocabulary and grammar. The purpose of this study is to reveal the importance of language skills and strategies through pragmatic analysis of trial language. This part focuses on the summarization and summary of the existing research theories at home and abroad. The author tries to make a relatively effective arrangement of the relative research status of the trial discourse, and has a relatively perfect combing of its context. On the basis of this, the author is inspired to some extent. It is of great help to continue the relevant research. Besides drawing lessons from predecessors, this thesis analyzes the speech acts of trial discourse (mainly refers to the use of Austin's speech act theory to conduct a comprehensive analysis of court speech. In addition to classifying speech acts in court and analyzing the sentence language of the most powerful judge in court, it emphasizes the use of linguistic relevant theoretical knowledge (including functionalist linguistics, psycholinguistics, etc.). Logical linguistics, sociolinguistics and so on, on the basis of collecting relevant real trial discourse cases, analyze the role of trial discourse in conversational reasoning and conversational form. It focuses on the discourse skills and related language strategies represented by different conversational forms and their influence on the outcome of court judgment, and on this basis discusses the power of court discourse. The problems of social system and the lack of humanistic care in the language of trial are reflected in the strategies. The research features of this paper are as follows: 1. Pay attention to the authenticity of the trial case and the high consistency with the relevant language points. Second, pay attention to the consideration of the trial role, and dig deeper into the coverage of the relevant language points. Third, pay attention to the specific discourse analysis of the trial language. Fourth, in the analysis of the language of the trial, we should pay attention to the absorption and induction of all kinds of references, absorb relevant experience, and on this basis get the corresponding inspiration and effective thinking. Fifth, the transformation of the role of the trial and the use of discourse strategies reflect the reflection on the social system.
