汉语语境中公正和正义概念的区别

【摘要】：汉语语境中的公正和正义两概念之间实际上是有一些细微差别的,两者的适用范围有一定的差别。正义是一个"应然"、"纯粹"的最高价值观层面上的事情,而公正则是一个将"应然"和"实然"结合在一起,依据"应然"的基本价值观进行现实社会的基本制度进行安排的问题;正义具有某种跨时代的、相对恒定的特征,而公正的具体内容则会随着时代条件的变化有所变化;正义是少数人才能够做到的事情,而公正则是多数人都能够遵循的事情。
[Abstract]:In fact, there are some slight differences between the concepts of justice and justice in Chinese context, and there are certain differences in their scope of application. Justice is a matter at the highest value level of "ought to be" and "pure". Justice, on the other hand, is a question of combining "ought" with "reality" and arranging the basic system of realistic society according to the basic values of "ought to be"; Justice has a certain cross-epoch, relatively constant characteristic, But the concrete content of justice will change with the change of times; Justice is the thing that few people can do, and justice is the thing that most people can follow.
