汉语“规范”浅说

【摘要】：我国古代没有"规范"专名,但并非没有"规范"观念。我国"规范"观念通过"规矩"、"权衡"等其他一些用语表达出来,而且颇具特色,很早便用于刻画"法"。西方法学引入"规范"观念,比较突出地反映在近代。中西"规范"观念,本身差别不大,可以互通互译。近代以来,"规范"译名经由日本传入我国。考察规范语源,有助于挖掘其理论意义,也有助于理解法或法律乃至法学本身。
[Abstract]:In ancient China, there was no proper name of "norm", but it was not without the concept of "norm". The concept of "norm" in our country is expressed by "rules", "weighing" and other terms, and it has its own characteristics, which has been used to depict "law" for a long time. The concept of "norm" was introduced into western jurisprudence, which was reflected prominently in modern times. The concept of "norms" between China and the West is not different in its own right and can be translated into each other. Since modern times, the translated name of Norm was introduced into China through Japan. The investigation of normative etymology is helpful to excavate its theoretical meaning, to understand law, law and even law itself.
