从文化差异角度论国际贸易合同的翻译

【摘要】:二十世纪后半期以来,经济全球化与国际贸易飞速发展。在国际贸易合作交往过程中,交易双方签订相关的法律合同,是至关重要的一个环节。而作为商务领域重要的沟通方式之一,合同不仅关系到合作能否顺利进行,更加承载着交易双方的直接经济利益。因此,准确而恰当的合同翻译在更好地实现国际贸易合同的功能,以及在避免任何可能产生的争议上起到至关重要的作用。 虽然国内众多学者从各种视角对国际贸易合同的翻译进行了探讨,并已取得诸多成果。但从文化差异视角对国际贸易合同翻译进行的研究却鲜有之。由于全球化的飞速发展,世界各国间的交往越发频繁,由此引发的文化差异与冲突在方方面面都带来了不小的影响,在国际贸易合同翻译中也有所体现。由此,在国际贸易合同的翻译问题上,我们不应仅从法律语言学或一般翻译理论角度对其进行探究,同时也应从中西方文化差异的角度展开讨论。本文做此研究以期对合同翻译实践有所帮助,并为法律执业者及译者们提供些许有益的参考或指引。 本文旨在探讨国际贸易合同的文化内涵,及其翻译策略。本文根据中西方文化差异的四个表现,即道德观,价值观,宗教信仰,以及思维方式这几方面,结合实例,找出词汇,句式以及语篇层面上国际贸易合同的文化内涵,并在此基础上提出国际贸易合同的翻译策略。 本文共分为七个部分: 引言部分回顾了前人总结的中西方文化差异,,以及国际贸易合同翻译准则,指出了文化差异在国际贸易合同翻译中可能的影响,进而描述了本文研究的目的和重要性。 第二部分作为文献综述,分别介绍了国内外现阶段对国际贸易合同翻译的研究,以及文化缺省及翻译补偿理论。并总结前人在文化差异对合同翻译影响的领域所做的得研究。 第三部分论述了中西方文化差异。首先概括了文化差异以及文化差异的形成原因。继而从不同的道德观,价值观,宗教信仰以及思维方式这四个方面总结出中西方文化差异的具体表现。 第四部分论述了国际贸易合同的篇章结构及语言特点。从格式以及包含的主要条款介绍国际贸易合同的篇章结构。并从词汇,句式及语篇层面详细论述国际贸易合同的语言特点。 第五部分讨论了国际贸易合同中体现的文化内涵。分别根据上文论述的文化差异存在的四个方面,即道德观,价值观,宗教信仰,以及思维方式的基础上,总结出国际贸易合同文化内涵。 第六部分提出了国际贸易合同在中西方文化差异下的翻译策略。根据在上一章中总结出的国际贸易合同中的文化内涵,分别从词汇,句式,语篇层面讨论其文化内涵下的翻译方法。最后一部分总结全文。对整篇文章做了全面总结,包括研究的主要发现,意义以及局限性。
[Abstract]:Since the second half of the twentieth century, economic globalization and international trade have developed rapidly. In the process of international trade cooperation, the signing of relevant legal contracts between the two parties is a crucial link. As one of the important communication methods in the field of business, contract not only relates to the smooth progress of cooperation, but also bears the direct economic interests of both parties. Therefore, accurate and appropriate contract translation plays a crucial role in achieving the functions of international trade contracts and avoiding any possible disputes. Although many domestic scholars have explored the translation of international trade contracts from various perspectives, many achievements have been made. However, there are few studies on the translation of international trade contracts from the perspective of cultural differences. With the rapid development of globalization, the communication between countries in the world becomes more and more frequent, and the cultural differences and conflicts caused by it have brought great influence in all aspects, and have also been reflected in the translation of international trade contracts. Therefore, on the issue of translation of international trade contracts, we should not only explore it from the angle of legal linguistics or general translation theory, but also discuss the cultural differences between China and the West. This study is intended to be helpful to the practice of contract translation and provide some useful reference or guidance for legal practitioners and translators. The purpose of this paper is to explore the cultural connotations of international trade contracts and their translation strategies. According to the four manifestations of the cultural differences between China and the West, that is, morality, values, religious beliefs, and ways of thinking, this paper combines with examples to find out the cultural connotations of international trade contracts at the level of vocabulary, sentence structure and discourse. On this basis, the translation strategy of international trade contract is put forward. This paper is divided into seven parts: the introduction reviews the cultural differences between China and the West summarized by predecessors and the translation criteria of international trade contracts, and points out the possible impact of cultural differences in the translation of international trade contracts. Furthermore, the purpose and importance of this paper are described. The second part, as a literature review, introduces the current studies on the translation of international trade contracts at home and abroad, as well as the theory of cultural default and translation compensation. It also summarizes the previous studies on the impact of cultural differences on contract translation. The third part discusses the cultural differences between China and the West. First of all, it summarizes the cultural differences and the formation of cultural differences. Then it sums up the concrete manifestation of the cultural difference between China and the West from four aspects: morality, values, religious belief and mode of thinking. The fourth part discusses the text structure and language characteristics of international trade contract. The text structure of international trade contract is introduced in terms of format and main clauses. The linguistic features of international trade contracts are discussed in detail in terms of vocabulary, sentence structure and discourse. The fifth part discusses the cultural connotation of international trade contract. Based on the four aspects of the cultural differences discussed above, namely morality, values, religious beliefs, and ways of thinking, this paper summarizes the cultural connotation of international trade contracts. The sixth part proposes the translation strategies of international trade contracts under the cultural differences between China and the West. According to the cultural connotations of international trade contracts summarized in the previous chapter, this paper discusses the translation methods of international trade contracts from the lexical, sentence and textual levels. The last part summarizes the full text. A comprehensive summary of the whole article, including the main findings of the study, significance and limitations.
