中国刑事案件庭审语篇中转述话语的语言特征及语用功能研究

　　法律语言是体现法律意志、实现和维护社会公平正义的重要手段。广义上它包括立法的书面语言及司法的动态口语。作为法律语言学研究的一个重要分支,庭审话语呈现了法庭审判活动中语言互动的动态过程,在其语言特征及语用功能方面都具有相对的独特性。在庭审过程中,参与者会采用各种各样的语言策略进行交际,以实现其各自的交际目的,而转述话语就是其中之一。本文旨在探索庭审语篇中转述话语的语言特征及语用功能。采用定量分析与定性分析相结合的研究方法,结合了维索尔伦的语言顺应论及廖美珍的目的论,提出了一个更适用于分析庭审转述话语的语言特征及语用功能的分析框架。具体而言,本文致力于,首先,分析转述话语在庭审语篇中的整体使用情况;其次,从转述视角、转述信息及转述态度三个角度来研究庭审转述话语的语言特征,阐释庭审活动中的语言使用者是如何在这三个方面做出语言选择以顺应庭审交际语境的。最后,探讨庭审转述话语在顺应交际语境后所实现的语用功能。为了解决这些问题,笔者选取了20场真实的刑事庭审案件作为语料,并在其中提取575个转述话语。通过分析,笔者发现,第一,整体上转述话语在庭审语篇中有较高的使用频率,集中使用于法庭调查和法庭辩论...
