房屋租赁合同中装饰装修物处理问题研究

【摘要】:近几年来,随着我国经济的快速增长以及人口流动的频繁,房屋租赁市场日益火爆,承租人为了最大限度地利用好租赁房屋,往往会对租赁房屋进行一定的装饰装修,从而使房屋租赁中装饰装修物的纠纷不断增多,对于此问题的处理也成为了法院判决中的重点难点。在《最高人民法院关于审理城镇房屋租赁合同纠纷案件具体应用法律若干问题的解释》(以下简称法释[2009]11号)公布之前,我国法律对处理装饰装修物纠纷这一问题上,也有所涉及,但相关规定都过于笼统,缺乏可操作性。法院在处理装饰装修物的所有权归属以及租赁合同当事人双方利益平衡时往往缺乏审判依据。前述司法解释出台后,从一定程度上弥补了以往立法的不足,但由于该解释没有明文规定租赁合同在不同效力下装饰装修物的所有权归属以及对租赁关系中各种求偿权没有进行明确区分,在认定装饰装修物的所有权归属以及如何平衡出租人与承租人的利益问题上,,仍存在着一定的缺陷。本文从该司法解释的不足之处出发,通过介绍添附制度与不当得利制度,论证在房屋租赁合同中,装饰装修物纠纷问题应当适用这两种制度,并对如何具体适用这两种制度解决现实问题作出了说明,以期能够良好地解决在房屋租赁合同中出现的装饰装修物所有权归属不明以及出租人与承租人利益失衡的问题。
[Abstract]:In recent years, with the rapid growth of our economy and the frequent population mobility, the rental market is becoming more and more popular. In order to make the best use of the rental housing, the lessee will often decorate the rental house to a certain extent. As a result, the disputes of decoration and decoration in the house lease are increasing, and the treatment of this problem has become the key and difficult point in the court judgment. Prior to the promulgation of the Supreme people's Court's interpretation of some issues concerning the specific Application of the Law in the trial of Urban Housing Lease contract disputes (hereinafter referred to as legal interpretation [2009] 11), the law of our country dealt with the issue of disputes over decoration and decoration, There are also involved, but the relevant provisions are too general, lack of maneuverability. When the court deals with the ownership of the decoration and the balance of interests between the parties to the lease contract, it often lacks the basis of trial. After the introduction of the aforementioned judicial interpretation, to a certain extent, it made up for the shortcomings of the previous legislation. However, since the interpretation does not expressly stipulate the ownership of the decoration and decoration under different effects of the lease contract and the absence of a clear distinction between the various claims in the lease relationship, There are still some defects in determining the ownership of decoration and decoration and how to balance the interests of lessor and lessee. Starting from the shortcomings of the judicial interpretation, this paper, by introducing the appended system and the unjust enrichment system, demonstrates that the dispute over decoration and decoration should be applied in the house lease contract. It also explains how to apply these two systems to solve the practical problems, in order to solve the problems of unclear ownership of decoration and decoration and imbalance of interests between lessor and lessee.
