原型理论视角下“法”字的翻译

【摘要】：1975年，加利福尼亚大学伯克利分校心理学教授埃莉诺·罗施(Eleanor Rosch)在心理学实验中提出了原型理论。此后，该理论被广泛应用于认知心理学及翻译实践。在原型理论视角下，，翻译被视作在一定时空条件下寻找最佳目的语样例的活动；一种通过识别原语原型，寻找目的语读者心中原型，进而依据目的语原型重塑原语原型的过程。鉴于此，原型理论为法律翻译开辟了新视野。本文以原型理论为框架，以“法”字的翻译为例，力图从以下几个方面探究“法”字的原型及其在翻译中原型效应的呈现。首先，从词源、语义含义、语用含义三个层面建构“法”字的原型，通过识解发现其原型存在范畴化的特性。其次，本文尝试性地提出凸显“法”字原型的翻译过程，认为“法”字的翻译即是对其原型识解及建构的过程：依据“法”的含义将其划分为上位范畴、基本范畴、下位范畴，据此寻找不同范畴中的原语原型，建构对应范畴中目的语读者原型，并重建原语以理解发现对应目的语中的原型。再次，本文针对翻译中实际原型与理想原型的偏离，使用了认知域转移、范畴一致性、文化补偿、描述性解释的翻译策略。总之，原型理论为法律翻译理论的构建及法律翻译实践提供了行之有效的方法。本文旨在从认知语言学角度出发探索法律翻译，从而起到抛砖引玉、另辟蹊径的目的，以期为今后法律英语翻译贡献一份绵薄之力。
[Abstract]:In 1975, Eleanor Rosch, a professor of psychology at the University of California, Berkeley, put forward prototype theory in psychological experiments.Since then, the theory has been widely used in cognitive psychology and translation practice.From the perspective of archetypal theory, translation is regarded as the activity of finding the best sample of the target language under certain time and space conditions; a process of reconstructing the prototype of the target language according to the prototype of the target language by identifying the prototype of the source language and looking for the prototype in the heart of the target language reader.In view of this, prototype theory opens up a new perspective for legal translation.Taking the prototype theory as the framework and the translation of the word "law" as an example, this paper tries to explore the prototype of the word "law" and its prototype effect in translation from the following aspects.Firstly, the prototype of the word "law" is constructed from three levels: etymology, semantic meaning and pragmatic meaning, and the characteristics of categorization of its archetypal existence are found through understanding.Secondly, this paper tries to put forward the translation process of protruding the archetype of "law", and holds that the translation of "law" is the process of understanding and constructing its prototype: it is divided into the upper category, the basic category and the lower category according to the meaning of "law".Based on this, we seek the prototype of the target language in different categories, construct the prototype of the target language in the corresponding category, and reconstruct the source language to understand and find the prototype in the corresponding target language.Thirdly, in view of the deviation between the actual prototype and the ideal prototype in translation, this paper uses translation strategies such as cognitive domain transfer, category consistency, cultural compensation and descriptive interpretation.In a word, prototype theory provides an effective method for the construction of legal translation theory and the practice of legal translation.The purpose of this paper is to explore legal translation from the perspective of cognitive linguistics so as to serve as a starting point and to explore a new way to contribute to the translation of legal English in the future.
