论关联理论对法律翻译实践的局限性

【摘要】：Dan Sperber和Deidre Wilson在他们的著作《关联：交际与认知》中首次系统地提出了关联这一概念，它是一种用来解释人类交际活动一般性规律的理论，将人类的交际过程看做是一个明示-推理的过程。在交际过程中，说话人通过明示交际行为，用明白无误的话语表达自己的意图，听话人则根据话语信息和话语语境，从说话人的明示信息中推导出说话人的交际意图。关联理论一经诞生，立刻引起了众多语言学家的关注。在Grice会话原则的基础上产生并创新出来的关联理论，以其新鲜的认知视角和强大的解释力，迅速被语用学，语义学，话语分析，乃至心理语言学，，认知语言学，逻辑学等推崇。与此同时，关联理论与翻译领域的结合也日趋受到关注。 E. A. Gutt是将关联理论应用到翻译领域的先驱，他在1991年出版的《关联与翻译》(Relevance and Translation)前言中充分肯定了关联理论对翻译的指导和解释作用，并称关联理论足以解释翻译中的一切现象。我国的语言学家们诸如林克难，何自然，赵彦春，王斌等都对关联理论与翻译的关系作了介绍与评述。大多数学者对关联理论对翻译的指导和解释力持肯定态度，也有少数学者提出了质疑，认为关联理论对翻译实践的指导具有局限性。通过阅读大量的相关理论和文章，本文作者将从一个更窄更具体的角度----法律翻译的角度入手，探讨关联理论对法律翻译实践的局限性，并重点回答了三个问题：1.关联理论是否能够解释翻译中遇到的所有问题。2.关联理论的解释和指导力对于法律翻译而言是否存在局限性。3.关联理论对法律翻译实践的局限性具体体现在哪些地方。限于篇幅和个人有限的知识水平，本文仅为初步研究，以期对以后的法律语言翻译研究起到抛砖引玉的作用。
[Abstract]:For the first time, Dan Sperber and Deidre Wilson put forward the concept of relevance in their book relevance: communication and Cognition, a theory used to explain the general laws of human communicative activities. The process of human communication is regarded as an ostensive-inferential process. In the process of communication, the speaker expresses his intention with unmistakable utterances through explicit communication, while the hearer deduces the speaker's communicative intention from the explicit information of the speaker according to the discourse information and the context of the utterance. As soon as relevance theory was born, it immediately attracted the attention of many linguists. The relevance theory, which is based on the Grice conversational principle, is rapidly praised by pragmatics, semantics, discourse analysis, psycholinguistics, cognitive linguistics and logic for its fresh cognitive perspective and powerful explanatory power. At the same time, the combination of relevance theory and translation has attracted more and more attention. E. A. Gutt is a pioneer in applying relevance Theory to the field of translation. In his preface to relevance and Translation, (Relevance and Translation) published in 1991, he fully affirmed the guiding and explanatory role of relevance Theory in translation. It is said that relevance theory is sufficient to explain all phenomena in translation. Chinese linguists such as Lin Ke-nan, he Nature, Zhao Yanchun and Wang Bin have introduced and commented on the relationship between relevance theory and translation. Most scholars hold a positive attitude towards the guidance and explanatory power of relevance theory on translation, while a few scholars have questioned the limitations of relevance theory in guiding translation practice. By reading a large number of relevant theories and articles, the author will explore the limitations of relevance theory on the practice of legal translation from a narrower and more specific perspective, and will focus on answering three questions: 1. Can relevance theory explain all the problems encountered in translation. Whether the interpretation and guidance of relevance theory has limitations for legal translation. The limitations of relevance theory to the practice of legal translation are embodied in what areas. Limited to space and limited personal knowledge, this paper is only a preliminary study, in order to serve as a guide to the later study of legal language translation.
