中美法庭判决书的语篇语义对比研究

对不同文化法律语篇本质的对比分析和研究不仅有利于跨文化研究,更有利于跨文化法律交流。然而迄今为止,中国的对比研究主要集中于影响英汉两种语言异同的一般规则上,鲜有学者关注英汉两种语言法律语篇的对比分析,而从语篇语义学的角度对法律语篇中的判决书的对比研究更为少见。判决书是法院根据判决写成的文书,是法律界常用的一种应用文体。以语篇语义理论为研究依据,从跨文化对比的角度,本研究将对中美判决书进行系统的对比分析和讨论,旨在探索中美两国判决书的异同点,进而挖掘影响两种语言判决书信息构建与语言实现的因素。在系统研究的基础上,马丁和罗斯于2003年较为完整的创建了语篇语义学理论。此理论包括五个子系统,亦即分析语篇的五种视角:评价、概念、联结、识别和语篇格律。评价即态度磋商,主要介绍态度的种类、介入的方法和评价的来源。概念即为经验体现,聚焦于语篇的内容,即活动的类型以及活动参与者的描述、分类和组成。联结主要研究语篇的内部逻辑关系—附加、对比、时间、因果等。识别关注的是识别和追踪文本中的参与者,研究人或物入篇后对读者的意义。语篇格律研究语篇的信息流,关心语篇组织过程中的信息脉冲是如何整体打包以便于读者理解...
